caring for said the animal during the period of impoundment <br /> including, but not limited to, costs of boarding and veterinary <br /> treatment if necessary. If the owner institutes an appeal <br /> pursuant to section 5-27, and the animal is ultimately determined <br /> not to be a dangerous animal, the owner shall not be charged the <br /> costs of boarding the animal . <br /> (3) Upon the impoundment of the animal pursuant to <br /> this subsection, the owner shall be given forty-eight (48) hours <br /> to show or apply for a license pursuant to section 5-27, or to <br /> appeal the determination that the animal is a dangerous animal <br /> pursuant to section 5-3 . <br /> (3) (4) If the owner fails or refuses to appeal or to show <br /> proof of or apply for a license within forty-eight (48) hours of <br /> impoundment, or if the owner at any time waives in writing all <br /> ownership interests in the animal, .44 - _ - ' : - , - - <br /> owner' s request prior thereto, the owner' s right to possession, <br /> title, custody or care of said animal may shall be permanently <br /> forfeited and said the animal shall may be euthanized in a humane <br /> manner. <br /> (5) If the owner' s appeal pursuant to section 5-3 is <br /> denied, the owner shall have forty-eight (48) hours after the <br /> denial to apply for a license pursuant to section 5-27 . The <br /> failure to apply within forty-eight (48) hours of the denial <br /> constitutes waiver of ownership rights in the animal . <br /> (4) (6) The owner of an animal who kills or causes serious <br /> injury to a person who is found guilty of criminal trespass as <br /> heretofore described shall not be subject to the violation <br /> provisions set forth herein. <br /> Sec. 5-29. Article to be more restrictive. <br /> (a) Due to the overriding public health and safety concerns <br /> related to the American Pit Bull Terrier or any other dangerous <br /> animals, the provisions of this article are purposely intended to <br /> be reasonable regulations, yet may be more restrictive than <br /> regulations found in other sections of this chapter. <br /> (b) If a conflict arises between the provisions of this <br /> article and other sections of this chapter, the provisions of <br /> this article shall prevail due to the public health and safety <br /> concerns . <br /> 27 <br />
