(a) The attack dog i at all times confined in an escape <br /> proof enclosure- and thc public ' is prot = _ =- - _- ' -_ _ ' - ct <br /> contact with it; or <br /> (b) The attack dog, when not confined, is reined or <br /> tethered to its mastcr, owner, or kccper over the age of eighteen <br /> (18) years; and <br /> (c) The owner of thc attack dog (s) is the holder of a <br /> currently valid permit issued by a proper Statc or Federal <br /> authority authorized to keep attack dogs . <br /> Duly authorizcd members of the police or other law <br /> enforcement departments including but not limited to gamc <br /> wardens, conservation officers, and other law dement <br /> officers shall be exempt from the provisions of this section. <br /> It shall be a violation of this chapter to intc-r-€ere with or <br /> impede a humane officer or othcr officcrs in the performance of <br /> their duties set forth in this chapter. <br /> SECTION V. Chapter 5, Article 4 .5, of the South Bend <br /> Municipal Code shall be, and hereby is, amended to read as <br /> follows : <br /> Sec. 5-27. Licensing. <br /> (a) A person shall not own an American Pit Bull Terrier, or <br /> any other dangerous animal for more than forty-eight (48) hours <br /> unless such animal is licensed under this article or an <br /> application for licensing of such animal under this article is <br /> pending. Persons who may disagree with his or her pet being <br /> determined to be a dangerous animal must file an appeal within <br /> said forty-eight (48) hours of receiving notification of that <br /> designation. _- - - _ • _ _ . _ _ - • _ <br /> an ordinance violation punishable by a fine of fifty dollars <br /> ($50 .00) payable through thc Ordinance Violation Bureau. <br /> (b) The owner of an American Pit Bull Terrier, or other <br /> dangerous animal shall apply to the City Controller' s office or <br /> the City' s duly authorized third party for the licensing of said <br /> animal . The application shall be on a form provided by the City <br /> Controller' s office or the City' s duly authorized third party and <br /> shall be accompanied by all of the following: <br /> 21 <br />
