• • <br /> l <br /> �( -9� <br /> ORDINANCE NO. 6 <br /> An ordinance to vacate all streets and alleys south of vacated Elder Street, east of Michigan <br /> Street, west of Carroll Street and north of first east/west alley south of Pennsylvania, including <br /> all streets and alleys south of Ohio Street, east of Carroll Street, west of Fellows Street and <br /> north of first east/west alley south of Pennsylvania Street. Further including Keasey Street east <br /> of Fellows and west of Marietta. All more particularly described as follows. <br /> STATEMENT OF PURPOSE AND INTENT <br /> Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority <br /> to hear all petitions to vacate public ways or public places within the City. <br /> A petition has been filed with the Common Council to vacate the public property described <br /> herein below. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, as follows: <br /> SECTION I. The Common Council of the City of South Bend having held a public hearing on <br /> the petition to vacate the following streets: <br /> A PORTION OF PARIS STREET <br /> A parcel of land located in the East Half (E'/) of the Northwest Quarter (NW%4) of Section Thirteen <br /> (13), Township thirty-seven (37) North, Range Two (02) East of the Second Principal Meridian and <br /> as shown on the recorded Plat of Elder's Addition Book 3, Page 4 and all being in the City of South <br /> Bend, Portage Township, St. Joseph County, Indiana, and more particularly described as follows: <br /> Beginning at the east right of way line of Carroll Street; thence east a distance of 416 feet, more <br /> or less, and a width of 40 feet to the west right of way line of Fellows Street, to the line of terminus. <br /> A PORTION OF WENGER STREET <br /> A parcel of land located in the East Half (E'/2) of the Northwest Quarter (NW%) of Section Thirteen <br /> (13), Township thirty-seven (37) North, Range Two (02) East of the Second Principal Meridian and <br /> as shown on the recorded Plat of Elder's 1st Addition, Book 3, Page 4 and all being in the City of <br /> South Bend, Portage Township, St. Joseph County, Indiana and being more particularly described <br /> as follows: <br /> Beginning at the east right of way line of Carroll Street, thence east a distance of 416 feet, more <br /> or less and a width of 40 feet to the west right of way line of Fellows Street, to the line of terminus. <br /> PORTION OF KEASEY STREET <br /> A parcel of land located in the East Half (E'/) of the Northwest Quarter (NW%4) of Section Thirteen <br /> (13), Township thirty-seven (37) North, Range Two (02) East of the Second Principal Meridian and <br /> as shown on the recorded Plats of Elder's 1st Addition Book 3, Page 4 and all being in the City of <br /> South Bend, Portage Township, St. Joseph County, Indiana and more particularly described as <br /> follows: <br /> Beginning at the east right of way line of Carroll Street; thence east, a distance of 416 feet, more <br /> or less and a width of 50 feet, to the west right of way line of Fellows Street, to the line of terminus. <br />
