Mr. Kevin J. <br />Commission Legal Counsel, advised bond and insurance <br />by the Miller Construction Company does cover the <br />nt of Redevelopment. <br />The following letter was received from our Legal Counsel, Mr. <br />Kevin J. Butler, which was read to the bidders present at the <br />bid ope ing and at this time for public record: <br />"Ii confirmation of our telephone conversation this <br />m rning, we will have the Redevelopment Commission <br />make clear when it awards the above - referenced <br />c ntract following the receipt of bids on September <br />1), 1973, that the contractor to whom the contract <br />i awarded will be given a series of notices to <br />p oceed based upon different phases of the twelve- <br />part project. The notice to proceed on the Clark <br />aid the R and V Realty buildings will not be given <br />u til such time as the Department obtains full <br />p ssession and use of the Clark property." <br />Jackson Wrecking Company was the low bidder in bid amount of <br />$10,996,00 and would be able to complete the job in 63 days <br />from time of notice to proceed. Our engineer's estimate was <br />$22,954 00. Our concern is that their bid is $12,000 below <br />the eng neer's estimate. <br />Mr. Har ey Jackson of the Jackson Wrecking Company was in <br />the and ence and advised he had bid low and was willing to <br />absorb lessor profit, as he is new in South Bend and needs <br />- 7 - <br />
