Acquisition Parcel No. 12 -5, R -66: Mr. Lennon said ACQUISITION PARCEL lave a request for a motion by the Commission for a NO. 12 -5, BROWN :el of land in front of the St. Joseph Bank & Trust PROPERTY, R -66 ►any, referred to as the Brown property, located at .210 South Michigan Street. Wiggins made the following motion: Having been advised by the owners of Parcel 12 -5, in R -66, that they contemplate construction improve- ment of this property, I move that we agree to dis- miss our condemnation suit on the condition and at the time that construction is started, no later than September 1, 1973, and on the further condi- tion that substantial work be undertaken by Septem- ber 20, 1973. A dent Helmen said this involves the Brown property, which is ;ently known as the "'hole in the ground." This motion says, !ffect, they will start construction by September 1 and will substantial construction by the 20th before we will dismiss condemnation suit. The motion made by Mr. Wiggins was seconded by Mr. Chenney and una imously carried. 6. I NEW BUSINESS a. Assignment for Disposition Parcel Nos. 4 -70 and 4 -72, less North 10 feet of 4 -72: Approval was requested of the Assignment from the First Bank and Trust Company of South Bend, Trustee for Land Trust No. 29 -5121, and A.G.A. Realty Company of South Bend, to ether as the Redeveloper of Disposition Parcel Nos. 4 -70 and 4- 2, less North 10 feet of 4 -72, Indiana R -66, to the South Bend Economic Development Commission's interest in property and authorizing transfer of deed to EDC. On motion by Mr. Wiggins, seconded by Mr. Wade and unanimously ca ried, the President and Secretary were authorized to execute th above Assignment. b. Assignment for North 10 Feet of Disposition Parcel No.. 4-72: Approval was requested of the Assignment from t e 1rst 9-ark and Trust Company of South Bend, Trustee for Land Trust No. 29-5121, and A.G.A. Realty Company of South Bend, together as thE Redeveloper of the North 10 feet of Parcel No. 4 -72, Indiana R-66, to the South Bend Economic Development Commission's inter- est in property and authorizing transfer of deed to EDC. On motion by Rev. Williams, seconded by Mr. Wade and unanimously carried, the President and Secretary were authorized to execute th above Assignment.
