REGULAR MEETING NOVEMBER 12, 2019 335 <br />Upon a motion made by Ms. Maradik, seconded by Ms. O'Sullivan and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 40-2019 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND, INDIANA, <br />APPROVING THE ACCEPTANCE OF TRANSFERS OF REAL PROPERTY <br />WHEREAS, the City of South Bend, Indiana, Board of Public Works (the "Board") is <br />empowered to purchase, acquire, and lease property on behalf of the City of South Bend, Indiana <br />(the "City") pursuant to Indiana Code Section 36-9-6-4 (the "Code"); and <br />WHEREAS, the Board, on behalf of the City of South Bend, Indiana, Department of <br />Community Investment ("DCI"), along with the Urban Enterprise Association of South Bend, <br />Inc. (the "UEA"), entered into that certain agreement, dated , 2014, with the <br />Indiana Housing and Community Development Authority Blight Elimination Program <br />("IHCDA"), wherein IHCDA granted an award to the City through DCI to work with UEA to <br />acquire and demolish blighted residential structures and facilitate an end use for the newly vacant <br />lots (the "Agreement"); and <br />WHEREAS, the UEA agreed to work with the City under the terms of the Agreement, so <br />long as the City took ownership of any properties acquired thereunder and still owned by the <br />UEA upon the termination of the Agreement; and <br />WHEREAS, in accordance with the Agreement, the UEA acquired and continues to own <br />certain real property described on Exhibit A (the "Property"); and <br />WHEREAS, due to the termination of the Agreement, the UEA desires to transfer the <br />Property to the City and DCI desires the Board to accept the donation of the Property pursuant to <br />the Code and in furtherance of the terms of the Agreement; and <br />WHEREAS, the Board of Directors of the UEA has executed a resolution authorizing the <br />transfer of the Property to the City; and <br />WHEREAS, the Board desires to authorize DCI staff to perform certain actions on the <br />Board's behalf to effectuate the acquisition of the Property. <br />NOW, THEREFORE, BE IT RESOLVED by the City of South Bend, Indiana, Board of <br />Public Works as follows: <br />1. The Board hereby accepts the transfers of the Property from the UEA on behalf of <br />DCI. <br />2. The Board authorizes Pamela C. Meyer, Director of Neighborhood Development <br />of DCI, to act on behalf of the Board to execute any documents or take any action on the Board's <br />behalf relevant to the acquisition of the Property, including but not limited to signing any closing <br />documentation and presenting the deed for recordation. The Board authorizes Ms. Meyer to <br />appoint a designee for the sole purpose of presenting the deed for recordation and executing any <br />documents ancillary to such recording. <br />3. This Resolution shall be in full force and effect upon its adoption. <br />ADOPTED at a meeting of the Board of Public Works of the City of South Bend, <br />Indiana, held on November 12, 2019, at 1308 County -City Building, 227 West Jefferson <br />Boulevard, South Bend, Indiana 46601. <br />CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS <br />s/ Gary A.
