Y,,Reselved by the Board of Public works that notice be sent to the following property owners to construct Walks Under Improvement Resolution No.42, Mills E. Case Lot 191 south east Add. Wilhelnina isher Lots 33--34-and 75 Fishers South Side Add. ,,-Remonstrance read and placed on file remonstrating against her assessments on the Condemnati of Washington Street,to-wit; Josephine 0.. Ford tezpectfully' remonstrates against the asgessmentm of alleged benefits to her Reallestate for said proposed improvement for the. reasons following,that is to x4y let. Upon her property discribed as follows; "Begin at the South West corner of lot 19 Oriai -final PlatIthence, East 40 t.,thence North 76ft.thence West 40;t,thence south76ft to begin -nin," $35-00 Also " East 24ft. of Tot P59 Original Plat " §,20.00 because the sat'd assess -ments, are excessive.2nd. That said realestate will not.nor will any part of it be ikhanced in value by said imprevc-went. 3rd. That said realestate will not.nor will rn-y part of it re rendered more accessible for any purpose than at present by s&.id improvement. Ath. That the award of alleaged damages by said Board of Public Works is excessive in this to Wit; a. That so much of the realestate proposed to be appropriatted as extends from the east Bank of the East Race to the East Bank of the stjieseph river in owned by the said City of south Bend. The same having been long since dedicated to public uses vs a street. b. That the prepor-ed award of $3500.00 to the Stephenson Manufacturing Co. for t�,e appropriation of land extending. from the east bank of the East Race to the East anl< of the St,,Joseph river is greatly excessive,for the reason that the fee in said landlif. in said company.is subject to a perpetup.1- easement in favor of the South bend Ma-iuf acturing Co its successors ftnd assigns1for a ---right-of-way and to occupy the same as a place for the deposit of meter*als for use upon. its Dam across said river and has been so used and occupie for more than forty year's la-t past by said South Bend Manufacturing Co.and its predecessor and until said easement is extinguished the fee of said land posesses only a nominal value.
