8. PROGRESS REPORTS (Cont "d <br />Inspe tion write -ups for exterior survey of the 24 <br />parcel /structures on the priority list will be com- <br />pletec com- <br />plete this week. All are along the Mall route. Survey <br />data as been compiled for this priority group of 24 <br />buildings with a total capacity for 32 ground floor <br />tenants. <br />Rehabilitation activity continues with workmen on <br />location at nine (9) buildings within project area, of <br />which seven (7) are directly located on Mall route. <br />Most vaults are not being maintained. Those that are <br />used are unsafe. <br />Also, the major problem is moisture. The openings <br />for c utes makes some of these buildings hard to re- <br />rent. <br />Mr. Wiggins asked what the legal status is of the <br />vaults under the sidewalks? Mr. Hammerschmidt ad- <br />vised they belong to the City. <br />Mr. Taylor advised there are no agreements we can go <br />back to, as originally they were all coal chutes. <br />There is no agreement, in writing, for them to occupy <br />this public space. This needs to be worked out with` <br />the City Attorney and the Board of Public Works. It <br />is public way, and anyone requiring public way is <br />only required by the Board to post bond holding the <br />City harmless from any damage. <br />Mr. Wiggins asked: "Our responsibility, as a Com- <br />mission Board, in the event we construct Pedestrian <br />Way, leave vaults in as they exist, it collapses <br />and falls in, who then is responsible? This is <br />City property. Are we responsible for being derelict <br />in our duty in times of change? Mr. Hammerschmidt <br />advised that there could be legal responsibility <br />to the City and indirectly to the Commission. <br />Mr. Taylor said these are in very bad shape and <br />the beams are rusted. We need to get together with <br />the Board of Works to have a Resolution for the Com- <br />mission with a recommendation. He said his policy <br />on the Board was that when the building was demolished <br />to require demolition of the vault, along with the <br />building, and, in most cases, these were demolished. <br />e.
