Friday May 14th. 1909. P <br />The _Board met in regular.session at 10:00 A. M. All -Members present. <br />Engineer reported ".Grade" on Burnes Street.fs. same approved. <br />Dearing given on Improvement Resolution No.:581 providing for a Trunk Sewer along th <br />following route; Beginning at Linden Avenue & Meade Street at the end of the Kenwood Ave. <br />Trunk Sewer, thence south on Meade Street to Huron street, thence East on Huron.Street to <br />olive street, thence south on Olive street to Calvert street.The following remonstrators <br />appeared in person and by attorneys and filed remonstrances and gave evidence in support <br />thereof, The Grand Trunk & Western Railway Company; New Jersey, Iridiona and Illinois Rail- <br />road Company; St. Joseph, South Bend & Southern R. R. Co; Chicago, Indiana & Southe•rn R. R. <br />Co; Lake Shore & Michigan Southern Railway Company; Michigan Central Railroad. Company; and <br />Jozeph Przestnor et al. And the Board having considered the matter and being advised in <br />the premises find. that each of said remonstrances should be and they are hereby over -ruled.. 0 <br />That the drainage district provided in said resolution correctly describes the property to <br />be benefitted, by said drain and which will eventually drain into said Trunk Sewer; that <br />all the real estate em.Vraced within said boundaries will so drain into said sewer and <br />that no property not included therein should be added to said drainw-e district, and the <br />Board further find that the benefits to said real estate embraced within said boundaries and <br />to the City of South Bend are equal to the estimated cost of said improvement. It is there- <br />fore ordered that said preliminary resolution No. 591 should be and the same is heretry in all <br />things ratified, confirmed and approved. On this question Edwin Nicar not voting; Messrs. <br />Papczynski and YLaInerny voting in the affirmative. <br />IMPROVEMENT RESOLUTION NO 553. <br />Resolved by the Board of Public Works of the City of South Bend, Indiana.. That an <br />improvement be made of the kind, size,, location and terminal points as follows: <br />Grade, Curb & Walk on Cherry street from Jefferson street to Division street. <br />Said improvement shall be known and designated as "The Cherry street Grade, Curb & <br />Walk Improvement" and shall be constructed according to the plans and specifications prepared <br />by the City Civil Engineer, Piled herewith., Notice of this resolution shall be published. on <br />-the 15th day of May andon the 22 day of May 1909, in the South Bend Daily Times. This <br />boand will give a hearing on this resolution at its office in the City Hall on the Sth day <br />of June, 1909, at T:15 P. M. <br />A Bond of Bonds to be issued to the Contractor in payment for such work where <br />the property owner signs waiver required, as -according to law. Which said bonds shall bear <br />interest at the rate of six per cent. per armor+, payable as provided by law. <br />Adopted this loth day of May 1909. <br />BOARD OF PUBLIC WORKS, <br />W., A. McInerny, Pres. <br />IMPROVEMENT RESOLUTION NO. 594„- <br />Resolved by the Board of Public Works of the City of South Bend, Indiana: That <br />an improvement be made of the kind, stze,.location and terminal points as follows: <br />Grade, Curb & Walk on Jefferson street from Walnut street to Cherry street. <br />Said improvement shall be known and designated as "The Jefferson street Grade, Curb <br />h Walk Improvement" and shall be constructed according to the plans and specifications pre - <br />Dared by the City Civil Engineer, filed herewith. Notice of this resolution shall be pub- <br />lished on the 15th day of May and on the 22 day of May, 1909, in the South Bend Daily Times. <br />This board will give aa, hearing ,on this resolution at its office in the City Fall on the 9th <br />day of June 1909, at 7:15 P. M- <br />A Bond or Bonds to be issued -to the Contractor in payment for such work where the <br />property owner signs waiver required, as according to law.
