The Option Agreement <br />was si ned a couple of years ago with us. The owners <br />reques ed additional time to operate their business <br />and ar now refusing to close. The contract time was <br />until ctober, 1969. Our alternative is to sue for <br />non -pe formance of contract or'go to condemnation' <br />procee ings. Commission Legal Counsel recommends the <br />latter route. <br />The se and parcel is only to-clear the title. The water in the <br />pumpinj <br />station will be a problem. Mr. Ashenfelter <br />adviseJ <br />we will have infiltration as long as the dam <br />leaks water <br />and this will never dry up. All the wells, <br />etc., are <br />presumably shut off.in the area. <br />Mr. Wi <br />gins asked if this was in the Cultural Site area? <br />Mr. Eb <br />1 advised that it is and that the City requested <br />this p <br />operty be included for demolition at this time. <br />The pr <br />perty is in the process of being transferred. <br />-7- <br />
