<br />appro e and provide for the execution of the First
<br />Amendatory Contract, amending Contract No. Ind. R -56
<br />(LG), dated the 31st day of July, 1968, by and be-
<br />tween the City of South Bend, Department of Redevelop-
<br />ment, and the United States of America. This Resolu-
<br />tion will authorize the President and Secretary to
<br />execute the First Amendatory Contract which covers
<br />the increased Relocation Grant for the Additional
<br />Relocation Payments and Replacement Housing Grants.

<br />Resol Lion No. 277 was adopted and unanimously ap-

<br />f Addendum No. 1 This is an addendum to the
<br />Contract for Professional Services between the City.
<br />of South Bend, Department of Redevelopment and Mr.
<br />Bruce C. Hammerschmidt, Commission Legal Counsel,
<br />dated the 18th day of April, 1968, and is for legal
<br />servi es during execution of the Downtown Urban Re-
<br />newal Project. This Addendum No., 1 amends the limita-
<br />tion f fees to read in the Contract: "shall be limited
<br />to the sum of Thirty -Five Thousand Dollars ($35,000)."
<br />This will change the maximum amount payable to the Legal
<br />Counsel, which was originally anticipated to be $45,000
<br />during the life of the Project. The .limitation is now
<br />amended from $1,800 to $35,000- maximum, which will be
<br />a fiv (5) year contract.
<br />President Wiggins asked if this was a maximum fee. Mr.
<br />Bellinger apprised this is a maximum fee in accordance
<br />with bar schedule rates, and the $35,000 is a maximum
<br />limitation. The billing will be for services rendered;
<br />however, this contract will not cover any costs for
<br />civil suits, if any are incurred.
