729 CURB,GRADE AND SIDEWALK I PROVE UT RESOLUTION No. 235. Resolved by the Board of Pub is .Works of the City of South Bend, St. Joseph County, State of Indiana, That it is deemed necessary to improve St. VINCENT STREET FROM ST. ALEXIS STREET TO THE FIRST ALLEY WEST OF LAWRENCE STREET AS FOLLOWS, to -wit: - By grading sai d street from property line to. property line, and the con struction of cement sidewalks and cement curb on both sides of said street where not already constructed. L All as shown on the plans, and in accordance with the profile detail drawings and speicifeataons.on file in the office of the Department of Public Works of said City. And such improvement is now ordered in accordance with the, profile, details, drawings and speicifcations on file in the office of the Department of the Board of Public Works of said City; and such imrovement is now ordered. The cost of said improvement, including the cost of street and alley intersections, shall be assessed upon the real estate abutting on said ST. VINCENT STREET FROX ST. ALEXIS STREET TO THE FIRST ALLEY WEST OF LAWRENCE STREET, all according to, the method and manner provided for in an Act of the General Assembly of the State of Indiana,entitled "An Act Concerning Yuncipal Corporations," approved March 691905, and in accordance with and -pursuant to the provisions of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred are to be paid in ten equal annual installments, with interest at the rate of Six per cent per anrum. A Bond or bonds shall be isued to the entraetor in payment of such work,unless the property owners pay said assessment before said bond or bonds are issued. Underno circumstances shall the City of South Bend, be, or be held responsible for any sum or sums' due from said property owner or owners for said work or for the collection of the same, or for the payment of any bond, bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the'-*fty from the assessments for such improvement, or such moneys as said City is by said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement, assessment of property, collection of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act and amendments thereto. Notice od this resolution shall be published on the llth. day of March 1913 and on the 1$th. day of March 1913 in the South Bend Daily Times. This Board will give : a hearing on this resolution in its office in the City Hall on the llth. day of April,1913 at 7:45 P.M. Adopted this Seventh day of Yarch,1913. BOARD OF PUBLIC WORKS. ,
