I/ raRADEICURB AND SIDEWALK IMPROVEMENT RESOLUTION NO. 2340 Resolved by the Board of Public Works of the City of South Bend-2 St. Joseph County, State of Indiana) That it is deemed necessary to improve VAN BUREN STREET FROM HOWARD AVENUE TO SANCOME AVENUE as follOwsl't0-wit- By grading said street from property line to property line, and the, construction of cement sidewalk and cement cubb on both sides of said street where not already constructed. All as shown on the plans,, and .in accordance with the profiles, detail drawings and spetifi6ations: on file in the office of the Department of Public Works of said City. And such improvement is now ordered in accordance with the profile,, details, drawings and specifications on file in the office of the Department of the spBoard or Public Works of said City; and such improvement is now ordered. The cost of said improvement.A including the cost of street and alley 4 RE -4--mterse-etions., shall be assessed upon the real estate abutting on said VAN BU N STREET FROM T-DWARD AVENUE TO SANCOME AVENUE all according to the method and manner provided for in an Act of the General Assembly of the State of Indiana, entitled "An Act Con- - cerning Municipal Corporationsg" approved March 6,1905, and in accordance with and pur- suant to the provisions of.all amendatory and supplemental acts thereto,, passed by the General Assembly of the StAL*e of Indiana. Assessments, if deferred, are to be paid in ten equal annuall-installmentsis with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in payment of such work, ubless the property owners pay said assessment before said bond or bonds are issued. Under no circumstances shall the City of South Bend.) be,, or be field responsible for any sum or sums,. due from said property owner or owners for said work or for the collection of the same, or for the payment of any bond,, bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as sl*all have been actually received by the City from the assess ents for such inprovementm or Such moneys as said City is by said above entitled Act required to pay. All proceedings had2 and work done in the making of said improvement, assessment of property., collection of asse sments and issuance of bonds therefor, shall be as provided for in said above entitled Act and amendments thereto. Notice of this resolution shall be published on the 11th. day of March 1913 and on the 18th. day of March.)1913 in the South Bend Daily Times. This Board will give a hearing on this resolution in its office in the City Hall on the lith. day arr April 1913 at 7:45 P.M. Adopted this seventh day of March,1913 Board of Public Works.
