N <br />Tuesday .ran., ;t _ 191= <br />Conti <br />MI CHI GAN STREET TRUNK .SEWER.. - <br />N® 216. <br />RESOLVED, By the Board of -Public Wo rKs of the City of South Bend, St. <br />Joseph County, Indiana, that it is desired and deemed necessary to <br />construct a sewer in Michigan Street and LaSalle Avenue, said City, <br />which, From its side and -charaefer, is not only intended and adapted <br />for use bjr property owners whose `property abuts along the line of said sewer-, but is <br />also intended and adapted for receiving sewage from collateral drains already con- <br />structed or 'which may be hereafter constructed., and the same is hereby ordered con- <br />structed in and along Mi chi gan Street and LaSalle Avenue, beginning at a point in the <br />center of LaSalle Avenue where the same intersects with the westerly bank of the St. <br />Joseph River, in the said City of South Bend; thence running west along said LaSalle <br />Avenue to Michigan Street with a sewer sixty (60) inches in diameter; thence south <br />along Michigan Street to the center of Washington Avenue with a sewer sixty (60) <br />inches in diameter thence still south along Michigan'Street to the center of <br />Jefferson Blvd. with a sewer fifty four (54) inches in diameter; thence still south <br />along Michigan Street to Monroe Street- with a surer forty-e;;gkt (48) inches in dia- <br />meter, together with all the necessary house and store' connections to the curb line <br />along the whole length of said improvement, andto be built in aceo'rdsnee vdth the <br />profile, specifi.cations, detail plans, maps and estimates new on file in the office <br />of the Department of Public Works of saaid. City, whiek ineludes all estimate of the <br />proportion that the cost of an adequate local sewer, built along the above line, bears <br />to the cost of the main sewer, to be built as follows: The cost of an adquate local <br />sewer, built along the line above described, is hereby estimattee, and fixed to be <br />of the cost of tke main sewer to be built along said line as <br />above set Forth, which proportion, as herein estimated and fixed, shall be taken and <br />adapted in all eomputations requiring a knowledge of the cost of :such local sewer if <br />built along the line where the main sewer is to be built. The cost of the c;onst rue- <br />tion of said sewer shall be divided as follows: - <br />So much of such cost as shall be equivalent to the construction of <br />an adequate local sewer not adapted to receive sewage from collateral drains or -sewer; <br />- if built along the proposed line as hereinabove set forth, shall be paid by the abut- <br />ting property holders and the said City of South Bend, if it -be determined that the <br />said City is benefited by said sewer in :the same manner and to the same extent as <br />local sewers, are paid for by them, under the Statutes in such cases made and pro- <br />vided.. <br />2• The excess of cost over and above what would be equvivalent to <br />the cost of a loal sewer, it built along said line, 'shall be assessed aged nat each <br />piece of property in the di st ri et or area to be drained and against the City, if it <br />be determined that the said City is benefited' by the said sewer, according to the <br />manner and method prescribed by law, all of which said property benefi(d ally af- <br />fected lies within the following- described territory in the City of South Bend, <br />County of St. Joseph, and State of Ind1ana, t o-wit : - <br />Beginning at the center of LaSalle <br />Avenue and the Rrst alley west of Michigan Street, in the City of South Bend.; <br />thence .south along the center line of said alley and said alley produced and ex- <br />tended, to the center of Ewing Avenue; thence east along the center of Ewing Avenue <br />to the first alley east of Mi chi gan Street; thence north along the first alley east <br />of Michigan Street; to the first alley south of Calvert Street; thence east along <br />said alley to the center of Witwer Avenue; thence north along the center of V/itwer <br />Avenue to the first alley south of Dubail Avenue; thence east along said alley to the <br />center of Carroll Street; thence north along the center of Carroll Street to the <br />a ley South of Pennsylvania Avenue; thence west along said alley to the center of <br />Witwer, Avenue; thence north along Witwer Avenue and through the alley between -lot s <br />Eighty-three (83) and eighty-four (94) Elder Place Addition, to the first alley <br />11orth of Pennsylvania Avenue; thence east along said a ley to the first alley west <br />of Carroll 5t reet ; thence north along the center of the First alley West of Carroll <br />Strut to a point One •Hundred. Fifty (150) , feet south of true south line of Sample <br />Street; thence we rt parallel a,nsl one Hundred Fifty (150) feet south of the south <br />line of Sample Street to a point One Hundred sixty-five (165) feet east of the east <br />lisle of Michigan Street; thence north parallel with -and one Hundred sixty-five (165) <br />feet east of the east line of Michigan Street to a point One hundred fifty (150) <br />feet south of the south line of Tutt Street; thence west parallel with and One Hundred <br />fifty (150) feet south of the south line of said Tutt Street to the southerly line <br />of the Lake Shore and Ili chi gan Southern Railway Comp any' e right of way; thence north <br />aeross lot Twenty-nine (P9) Denniston's Fellows' Addition to the north and south <br />alley between Columbia Street and Fellow Street; the still north following the <br />continued. <br />
