Resolved, that notices as to the amounts of assessme--qts be published for six ,conseeutive days in the South Bend Daily Times, commencing on the 26th. day of August, 1912, stating that this Board will give a hearing on the amount of such assessments at its office in}te the City Hall ox the 13th. day of September 1912 at 7:45 P.I. Resolved further, that the entire work under the above contracts be accepted anal approved and the final estimate thereon. allowed. Notice of this Resolution shall be published on. the 26t.h. day Of September, 1912, in the South Bend Daily Times, stating that this Board iedll give a hearing on the acceptance of such work at its office in the City Hall on the 13th. day of September 1912 at 7:45 P.M. GRADE, CURB AND SIDEWALK IMPROVEMENT RESOLUTION NO. 203. RESOLVED by the Board of public Works of the City of South Bend, St. J Joseph County , State of Indiarm, That it is deemed necessary to improve COLFAX AVENUE FROM BIRDSELL STREET TO WALNUT STREET , by grading said Colfax Aven.e from property line to pro— perty line, and the construbtiox of cement sidewalk and Bement curb on both sides of said Colfax Ave .e; All as shown on detail plans, profiles anal specifi eations on file in the office 'of the Department of Public Works of the City of South Bend, India na. And such improvement is now erdere d in accordance with the profile, details, drawings anal speci— fications on file in the Office of the Department of the Beard Of Public Wanks of said City; and such improvement is now ordered. The cost of said improvement, including the cost of street and alley inter— seetions, shall be assessed upon the real estate abutting on said COLFAX AVENUE FROM BIRDSELL STREET TO WALNUT STREET all according to the method and manner provided for in ax act of the General Assembly of t e State of Indiana, entitled, "An Art Concerning Muni#al Corporations". approved Larch 6, 1905, and in accordance with and pursuant to the pro— visions of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred, are to be .paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A Bond or bonds shall be issued to the cox rioter in payment of such work, unless tthe property owners pay said asses meat before said bond or bonds are issued. Under no circumstances shall the City of South Bend, be, or be held responsible for any sum or sums, due from said property owner or w owners for said work or fort he eolleetiox of the same , or for the payment of any bond, bonds, certificate or certifieates, i - sued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assesments for such improvement, or such moneys as. said City is by au d above. entitled Act required to pay. All proceedings had, and work done in the makine of said improvement, assessment of property, collection of assessments and issuance of bonds thereofr, shall be as provided for in said above entitled Act and amendments thereto. Notice of this Resolution shall be published on the 21st . day of Augi st 1912 and on the 28`th. day of August, 1912 in the South Bend Daily Times. This Bard will give a hearing on this resolution in its office in the City Hall on the27th. day of September 1912 at 7:45 P.M. Adopted this 20th. day if August, 1912. President.
