EAST OF BERTRAND ST./ECLIPSE PL. INTERSECTION <br />Mr. Gilot stated an application for a Revocable Permit has been received for the purpose of <br />allowing the installation of a 6" extraction well to be installed in the right-of-way 250 Ft. east of <br />Bertrand St./Eclipse Pl. intersection. The encroachment shall remain in the right of way until the <br />time as the Board of Public Works of the City of South Bend shall determine that such <br />encroachment is in any way impairing or interfering with the highway or with the free and same <br />flow of traffic. Upon a motion made by Ms. Maradik, seconded by Ms. Dorau and carried, the <br />Revocable Permit was approved subject to obtaining all permits and bonds required by the <br />Engineering Permit Office, and a copy of any reports generated from the drilling provided to the <br />city. <br />APPROVE REQUEST FOR HOUSE MOVE — TRANSFORMATIONAL SPACES INC <br />In a letter to the Board, Mr. Chuck Bulot, South Bend Building Commissioner, requested the <br />Board's approval for him to issue a moving permit to Wolfe House Movers, LLC, on behalf of <br />Kevin Mitschelen, Director of Transformational Spaces, to move a house and unattached garage <br />from 1003 St. Vincent Street to 739 France Street. He noted all utility companies and other city <br />department involved have given their approval and all required permits and insurance and other <br />related documents have been provided. Therefore, upon a motion by Ms. Maradik, seconded by <br />Ms. O'Sullivan and carried, the request was approved. <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE A PORTION OF THE <br />FIRST NORTH/SOUTH ALLEY EAST OF NILES AVE. SOUTH OF HOWARD STREET <br />Mr. Gilot indicated that Camille Robinson, 934 N. Niles Ave., South Bend, IN 46617, has <br />submitted a request to vacate a portion of the above referenced alley. Mr. Gilot advised the <br />Board is in receipt of unfavorable recommendations concerning this Vacation Petition from the <br />Community Investment and Engineering Departments who state the vacation would make access <br />to the lands of the aggrieved person by means of public way difficult or inconvenient and would <br />hinder the use of a public right of way by the neighborhood in which it is located or to which it is <br />contiguous, thereby violating the criteria of I.C. 36-7-3-13 regulating vacations of the right-of- <br />way. Therefore, Ms. Maradik made a motion recommending denial of the request for vacation. <br />Ms. Dorau seconded the motion which carried. <br />RATIFY APPROVAL AND/OR RELEASE CONTRACTOR EXCAVATION AND <br />OCCUPANCY BONDS <br />The Division of Engineering Permit Department recommended that the following bonds be <br />ratified pursuant to Resolution 100-2000 and/or released as follows: <br />
