shall be limited solely to the Tordie ing issue, ana provia I r 6F 'firf"TIS10i IS <br />of the agreement shall remain in full force and effect without amendment for the duration <br />of the agreement. <br />SECTION 11 - FAMILY AND MEDICAL LEAVE ACT, The Employer is required <br />to comply with the Family and Medical Leave Act of 1993 (".FMLA") with respect4t <br />employees covered by the Agreement. <br />Accordingly, the Union and Employer agree that, eligible employees shall b <br />granted unpaid leaves of absence as required under the FMLA, provided: that employe <br />shall not accrue other benefits during such leaves; that the Employer may requi <br />certification of serious health conditions and medical necessity; that not withstanding an <br />other 1 <br />provisions of this Agreement to the contrary, the Employer may exercise i <br />discretion with respect to conditions associated with, or that may be placed upon, suc <br />leaves to the fullest extent permitted by said statute; and that while any employee is o <br />e n c 0 <br />an FMLA leave, the Employer shall pay to the welfare fund identified and referred to i <br />11 <br />Article Vill of the Agreement the minimum amount of contribution necessary to maintai <br />the FMLA-required health plan coverage to such employee while on said leave, whi <br />amount shall be established annually in an actuarially sound manner by the Trustees <br />such fund. <br />Section 13. Promotion of the Association: The Northwest Indiana Contractors <br />Association of Indiana and the UNION agree to appoint a committee to meet bi-monthly <br />for the purpose of promoting the Association. <br />ARTICLE IV <br />HOURS OF WORK, OVERTIME, SHIFT INORK <br />AND PAYMENT OF WAGES <br />work. <br />Section 2. WORK INEEK. The regular work week shall consist of five (5) <br />consecutive days, Monday thru Friday. <br />Section 3. HOURS OF WORK. On a regular work day, the hours of work will be <br />8-00 A.M. to 4:30 P.M. with one half hour off from 12:00 noon to 12:30 P.M. for lunch. <br />Section 4. ADJUSTED INORK DAY.
