The sub -contractor shall <br />sign the Local Agreement, post all <br />necessary bonds and abide by all terms <br />of the current Agreement. <br />The Employer agrees not to sublet, <br />assign or transfer any work covered by <br />this Agreement which is, or may be <br />performed at the site of the construction <br />project to any person, firm or <br />corporation except those subcontractors <br />who subscribe and agree, in writing, to <br />be bound by this Agreement and <br />complies with all the terms and <br />condition therein. <br />A signatory Prime Contractor that <br />77 <br />elects to subcontract to a non -signatory <br />union contractor for work covered by <br />this agreement shall provide a wage and <br />welfare bond in favor of the Union for <br />any unpaid wages and fringe benefits of <br />the non -signatory subcontractor. <br />RE -FABRICATION <br />Section XXXXIV. If offsite fabricated <br />steel delivered to the jobsite requires re - <br />fabrication, then at the sole discretion of <br />the contractor, one of three options listed <br />below shall be implemented: <br />1, send it to the original Fabricator <br />2. repair on site by Ironworkers #395 <br />3. send it to an organized Ironworker <br />shop. <br />SETTLEMENT OF DISPUTES <br />Section XXXXV.
