and deductions, an amount equal to the <br />monthly contributions and deductions of <br />such employer as estimated by the <br />Trustees. <br />If an employer's delinquency, <br />including any assessment of liquidated <br />damages, is not paid in full within <br />seventy-two (72) hours after said <br />Employer is notified of such delinquency <br />by the Union Trustees, the employer <br />shall be liable, in addition to the <br />contributions and liquidated damages, <br />for claims for the extent of benefits to <br />which the employee would have been <br />entitled if the required contributions had <br />been made plus all reasonable legal fees <br />incurred by the various fund office in <br />enforcing the payment thereof. <br />It shall be considered a violation of <br />this Agreement for any employer to fail <br />to pay or comply with any provisions of <br />this Article, or any rule or regulation <br />made by the trustees administering the <br />said various funds that the employer had <br />failed to pay in full any sums due the <br />various funds under this Article and that <br />such failure has continued for seventy- <br />two (72) hours, the Union may remove <br />all employees from such employer's <br />employment until all sums due from the <br />Employer under this Article have been <br />paid in full. This remedy shall be in <br />addition to all other remedies available <br />to the Union and the Trustees, and may <br />be exercised by the Union, anything in <br />the collective bargaining Agreement to <br />the contrary not withstanding. Such <br />removal of employees to collect <br />contributions and deductions to the <br />various funds shall not be considered a <br />violation of this Agreement on the part <br />of the Union and it shall not be a subject <br />of arbitration. <br />When any Contractor employing <br />members of this local union becomes <br />delinquent in the payment of fringe <br />39 40 <br />
