Information Submitted and Received. Participant is solely responsible for, and assumes all liability regarding: (i) the information and content contributed to the Network; (ii) the information and content Participant posts, transmits, publishes, or otherwise makes available through the Network; (iii) its interactions with other users through the Network, or as a result of using the Network; and (iv) information received from other users through the Network. Risk Assumption and Precautions. Participant assumes all risk when using the Network, including but not limited to all aspects of hiring and employing a user of the Network. Participant agrees to take all necessary precautions when interacting with and/or meeting users through the Network. Indemnification. Participant agrees to indemnify, defend, and hold CICP, its subsidiaries, and affiliates., and officers directors., harmless from any loss, liability, claim, expense, or demand, including reasonable attorneys' fees and investigative costs, relating to or arising from Participant's participation in the Pilot, including the receipt of any personal information, in violation of this Agreement and/or relating to Participant's obligation to safeguard the privacy and security of such personal information in Participant's care, custody, or control. Ascend reserves the right to defend any such claim, and Participant agrees to provide Ascend with such reasonable cooperation, assistance, and information as may be requested, Relationship of Parties. In carrying out its responsibilities under this Agreement, each Party shall act as an independent contractor with respect to the other and not as an employee, agent, partner, or joint venturer of the other. Neither Party shall have, or hold itself out as having, the ability or authority to bind or create debt for the other Party in relation to the subject matter of this Agreement or otherwise. This Agreement does not constitute or create an employment, agency, partnership, or joint venture relationship between the Parties.
