BOWEN SAFETY POLICY MANUAL <br />g. An employee is prohibited from reporting for duty or remaining on <br />duty when the employee uses any controlled substance, except <br />when the use is pursuant to the written instruction of a physician <br />who has advised the employee that the substance will not <br />adversely affect their ability to safely perform their duties. <br />h. DOT covered employees that engage in prohibited conduct will be <br />immediately removed from safety -sensitive functions and will be <br />subject to discipline as outlined in the section. Rehabilitation <br />including return to duty and follow-up testing will follow minimum <br />DOT requirements if not as stringent as described in this section. <br />Reference Section 3.3.D for Disciplinary Procedures <br />C. Testing Method <br />Unless governed differently by applicable laws, employees will be subject to <br />testing methods described below. <br />1. All non -negative tests for controlled substances and alcohol will be <br />confirmed with a second reliable testing method. Initial testing for <br />controlled substances will be of the immunoassay type, with all <br />confirmation testing being by gas chromatography/mass spectrometry. <br />Chemicals to be tested are listed in the SAMSHA Drug Screen Table below. <br />2. Bowen may choose to preform POCT (Point of Collection Test) drug tests <br />for pre -employment and random testing. If a person receives a negative <br />result, the person may begin work immediately. If a person receives a non <br />negative result, the person shall not be eligible to work. The person shall <br />remain ineligible until Bowen receives confirmation from the MRO <br />(Medical Review Officer) that the specimen meets the guidelines of this <br />policy. <br />Post incident/accident testing may only be done in extenuating <br />circumstances and approved by Safety Department. <br />3. Bowen reserves the right to test covered employees for additional <br />substances including but not limited to substances listed on Schedules I <br />through V of Section 202 of the Controlled Substance Act and in <br />Regulation 21 C.F.R. Section 1308.11-15 (examples include synthetic <br />marijuana and designer stimulants). Initial breath alcohol tests will be <br />screened for .02 or higher. For results .02 or higher a confirmation test is <br />required. Employees will be required to wait 15- 30 minutes to be re- <br />tested. A breath alcohol test result of .04 or higher will be considered non - <br />negative. Breath alcohol test results of .02 - .0399 will be considered <br />negative, but employee will be asked to leave the job site until the next <br />scheduled shift.
