Protocol for a Positive Test <br />1. Upon determining that a drug test is a legitimate "positive", the MRO will contact the <br />EAP. Any treatment or further testing requirements is at the discretion of the MRO/EAP. <br />If the individual is deemed able to continue working and the individual attends all <br />treatment as recommended by the EAP they will continue to be in the eligible pool. If the <br />individual is deemed unable to continue working or if they do not comply with the <br />treatment recommended they will be placed in the ineligible pool. The MRO will inform <br />LU 153 in writing if the individual is unable to continue working. If the individual is <br />unable to continue working the MRO will communicate in writing that a recommendation <br />for return to work, (if the individual was or would be working for Northern Indiana <br />NECA/LU 153 affiliated employer), must be given by the EAP to the MRO before the <br />MRO can decide whether the individual can return to work. A copy of this <br />communication must be forwarded to the LU 153. If the individual chooses not to utilize <br />the EAP or not to follow the EAP's recommendation, he/she will be required to wait for <br />30 days from the date of initial contact with the MRO before being allowed to test again. <br />During this 30-day waiting period, the individual's Northern Indiana NECA/LU 153 <br />eligibility status will be "not eligible" and the Local Union will be notified so the <br />employing contractor may also be notified. <br />2. Upon making the phone call to the EAP, the individual will attend the evaluation <br />appointment that had been set up by the MRO. During the evaluation, the EAP counselor <br />will request that the individual sign a release authorizing EAP communications with the <br />MRO.
