4217 LOCAL. SEWER IMPROVEMENT RESOLUTION NO 171. RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUIF BEND, ST. JOSEPH COUNTY STATE OF INDIANA, That the construction e'f a local sewer,intended and a- dapted only for local use by the property holders whose property abuts thereon, and not intended or adapted for receiving -sewerage from collateral drains, be and the same is hereby ordered in and along St. Louis Street from Cedar Street to Miner Street viz:- Be- ginning at the center of Cedar Street and St. Louis Street thence north along the cen- ter line of St. Louis Street to -the center of Miner Street with & 10 inch vitrified pipe sewer, together with the necessary manholes,inlets and house can nections to the curb line along=,the line of said improvement, and said sewer, with all appurtenances shall be constructed in accordance with the profile and speicifcations now on file in the office of the Department of Public Works of said City. The cost of said improvement shall be apportioned against and paid by the property holders whose property abuts thereon, and upon the City of South Bend if the City is benefited by said improvement, all accord- ing t Ia the method and manner provided for in Act of the General Assembly of the State of Indian&,entitled "An Act Concerning Municipal Corporations," approved March 6,1905. A Assessmentsm if deferred, are to be paid in ten equal annual installments, it th inter- est at the rate of Six ,Per cent -per annum. A Bond or bonds. shall be issued to the cen- tractor in payment for such work, unless the property owners pay said assessments before said bond or bonds are issued. Under no circumstances shall `the'City "'lf'South Bend be a or be. held responsible for any sum or sums clue from said property owner or owners for ail said work, or for:.the collection of sam*,:or for the payment of any bond or bonds, certt ficate or certificates, issued to said contractor in payment for such York, except for such moneys as shall have been actually received by the City from the assessments for such ,improvement,. or sus moneys as said City is by said above entitled Act required to pay.. All proceedings .had, and work done in othe making of said improvement, assessment of .property, cp llections of assessments and issuance of bonds therefor, shell be as providd for in .said above entitled Act.: Notice of this resolution shall be pubished o the 7th day of May and on the 14th. day of May 1912 in the South Bend Daily Times. The Board will gives, hearing on this resolution at its o ffi ce in .the City Hall on -the 28th. day of June 1912. JOSEPH COUNTY STATE OF INDIANA, That the construction of a local sewer,intended arid& adapted only for local use by the property holders whose property abut,a thereon, and not intended or adapted for receiving sewerage from collateral drains, be and the same is hereby ordered in and along GARST STREET FROM FRANKLIN STREET TO A POINT ABOUT 100 FEET WEST TO THE WEST LINE OF LAFAYETTE STREET Viz: - And said .sewer, w th all its appurtenances shall be constructed -inac- cordance with the profile and speic fications now on file in the office of the Department of Public Works of said City. The cost of said improvement shall be apportioned against and paid by the property, holders whose property abuts thereon, and upon the City of Semi Bend if the City is benefited by said improvement, all according be the method and man- ner provided for in Act of the General Assembly of the State of Indiana,entitled "An Act Cenceming Municipal Correeations," approved March 6,1905. Assessments, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A Bond or Bonds shall be issued to the contractor in payment for- such work,unless the roperty owners pay said assessments before said bond or bonds are is- sued. Under no circumstances shall the City of South Bend be or be held responsible foe any sum or sums due from said property owner or owners for said vork, or for the col- lection of same, or for the payment of any bond or bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the Assessments for such improvement, or it kuch moneys as said City is by said above entitled Act .required to pay.
