Mr. Lambert absent. ✓ Excavation bond t-o the amount of One Thousand ($1000) Dollars signed Mitred P1 Futter and approved by the Board. Fex ,v-Ation bond to the amount of One Thousand Dollars ( 1000) sigoe d by Joseph 0; Huber' and approved by the Board. Excavation bond to the amount of One Thousand ($1000)Dollars signed byCharles F. P avey and approved by the Board. ° Fred P. RittWs release from Bond. The undersigned, the Board of Public W*tk s of the City of South Bend, Indiana, hereby release and discharge Fred P. Futter, as Principal, and the American Surety Company of New York, as Surety, fro m any and all, further liabil- ity upon that certain bond numbered 800083 made, executed and delivered by said Principal and said Surety -,to the City of South Bend on the 9th. day of July,1910, and conditioned in, substance for the faithful performance by said Principal of any and all work if whatsoever kind, nature and description untertaken by him in and ;_:upon, the streets of the City of South Bend, Indiana: which said bond was exe- cuted on said date by said Priak1pal and said Surety in the sum of One Thousand ($1000) Dollars,. and which bond is known as Bond for Excavation in st reet s-* Dated at South Bend, Indiana, this. 1st. day of Apri121912. RESOLVED, By the Board •d Public Works of the City ®f South Bend,Indiana that it is desired and deemed necessary to make the following described public im- provements in the aforesaid City as authorized by the following numbered improvemk Resolution adopted by said Board on 2nd. day of April 1912.' Resolved that an improvement be made of the kind, size, to cation and terminal points as follows: The improvement of Woodward Ave. and Blaine Ave. from, the South line of the Mi chi gan Air Line Rai 1 ro ad Companies ri ght -o f-way to Queen Street. By grading the said street from the South line of said Companies right- of-way to McCartney Street and construction of cement walks on the west side from the south line of the Mi chi gan Air Line Companies ri ght -o f-way to Queen St re et and construction cement curb on both sides of said street from the south line of the safif railroad right-of-way to Queen Street. All as shown on detail drawings, plans and profiles of said improvement on file in the office of the department of Board of Public Wo rk s of t n.e City of South Bend, Indi ana. All in t r:e City of South Bend, County of St. Joseph and State of Indiana. And such improvement is now ordered. Said improvement shall be known and designated as GRADING OF BLAINE AND WJODWARD AVEf S CONSTRUCTION OF WALKS AND CURBING PART WAY OF STREET UNDER IMPROVEMENT RESOLUTION NO. 143, in The City of South Bend, Indiana. Notice of this resolution shall be published on the *A*h. day of April and on the lei; h. day of Apri1,1912 in the South Bend Daily Times. Said Board has ' fixed the loth. day of May 1912 as a date upon which remonstransex may be filed. or heard by persons interested or affected by said public improvements and on said day at 7:45 P.M. said Board will at its said office hear and consider any remonstrators and persons interested or whose pro- perty is affected by said public improvement and dill decide whether the bene- fits that will accrue to the p rope rty, abutting and adjacent to the proposed im- provements and to said City,will be equal ot,or exceed the estimated cost of the proposed improvements, as estimated by the City Civil Engineer. A Bond or bonds to be issued to the contractor in: payment of such work where the property owner signs waiver required,as according to law. Which said bonds shall bear interest at the rate of six per sent per annum.,payable as provided by law. Adopted on the 2nd. day of April ,1912.
