<br />That it is deemed and desired necessary to construct a Trunk Sewer on Fora: Street from
<br />Olive Street to Kosciusko St re et which, from its size and charact e r, i s not only, intended
<br />and adapted for useo f the property holders whose property abuts along the lines of -said
<br />sewer,but is" also intended and adapted to receive sewerage -from collateraal drains already
<br />constructed or which may be hereafter constructed.
<br />Beginning at the center of Olive Street, and Ford Street; thence east along
<br />the center line of said Ford Street to the center of 'Barren Street with a 2.4 :nch Vitrifie
<br />pipe;thence still East along the center ofFord Street to the. Center of Jackson Street
<br />with a 20 inch pipe; thence still East along the center line of Ford Street to the center
<br />of Kusciuzk"o Street with a 19 inch pipe,together with the house. connections to the curb
<br />line along the line of said improvement, nd said sewer,with all appurtenanceg,sha.11 be con
<br />structed in accordance with profiles,details,dr€awings and specifications on file in the of
<br />office of the Department of Board of Public Works of said. City. .
<br />The cost of the construction of s«id- newer shall be divided as follows: 1.
<br />So much of suhh cost as sha, 1 be equivalent to the construction of an adequate local
<br />sewer not adapted to receive the sewerea.ge` from collateral drains or sewer,if built along
<br />the proposed lines as. herein set forth, shall be pr id for by the abutting property holders
<br />and. by tae City of South Bend ,Indi€�na,if it be determined that the said City is benefited
<br />by the said sewer,in the manner and to the sizie extent as local sewer are paid for by them
<br />under the statue in such cases made and provided. 2. The excess cost over and above what
<br />would be equivalent to the costa o`f a local sewer,it built along the lines, shall be a,ssesse
<br />against each pie ue of property in the district or area to be drained,and against the City
<br />of South Bend, Indiana,,if it is determined that the City is benefited by the said sewer,a
<br />according to the manner and method prescribed by law; all of whichsaid property bene—
<br />f'icia,lly affected lies within the following described territory in the City of South
<br />B end, I ndi an€a. to —wit: —
<br />Beginning at the intersection of the center line of Olive Street and the
<br />fi rst Alley North of Ford Street; thence East along the center line .of the first Alley
<br />North of Ford Street to the First North and. South Alley West of Harris Street;thence south
<br />along the center line of the first Alley west of Harris Street to the Center of the Grand
<br />Trunk Western Railway Companies right—of—wayto the center line of Olive Street;thence
<br />North along the center line of Olive Street to the center line of the first alley North of
<br />Ford Street ,which point is the place of beginning. And each piece of ,property in said, dis•
<br />trict or area, above described,including the abutting pr.-,perty holders and the City. of Sout7
<br />Bend, Indiana,if the said City is benefited,shallbe assessed,as aforesa,.i.d,to pay the cost
<br />over and ab,q,ve what would be gqutvalent to the cost of. a local sewer; all of wriich will
<br />more fully appear by reference to the prof'ileg,details,draw.ings and specifications on file
<br />in the office of the Department of Board of Public Works. And such improvement is,now
<br />ordered.

<br />UNDER IMPROVEMENT RESOLUTION -40. 134. in,' CITY '-) F SOUTH BEND 91NDI ANA.
<br />Notice of this Resolution 7hall be published. on the 9th. day of March
<br />1912 and on the 16th. day of March 1912 in the South Bend Daily Times.
<br />Said Board has fixed the 12th. day of April 1912 as a date upon -which remon-
<br />strances may be filed or heard by persons interested or affected by said Public Improve—
<br />ments and on said day at 7: 45 P.M. said Board will at its said office dear and consider ani,
<br />remonstrators and persons interested or whose ;.roperty is affected by said Public Im—
<br />provement and will decide whether the benefits that will accrue to the property,abutting
<br />an adjacent to t..e prof»4ed improvements and to td.d City,ill be equal to,or exceed the
<br />estimated cost of t,._e proposed improvements,as estimates: by -the City Civil Engineer.
<br />A bond or Bonds to be issued to the contractor in payment of such work wriere the property
<br />owner siL-ins w iver reauired,as according to law. Which sr,.id bonds shall bear interest at
<br />the rate of six per c:eTt per �=.nnum2pay4bje as ;provided by law.
<br />Motion made,seconded and carried,that the foregoing re-olution be unanimously adopted
<br />by the Board on the St h. d ty of March,1912.
<br />ORDER SELECTING THE KIND OF PAVEMENT
<br />Concerning the improvement of r'st. Alley East of Emerick Street from
<br />LaSalle Avenue to Colfax Avenue in p-:%rsuaance of Improvement Resolution No. 117 & 117 —A
<br />1912 of the City of South Bend, India,naa, the preliminary order for said improvement here—
<br />tofore adopted is hereby conf'immed. The Board now orders that so much of said street be
<br />improved with Vitrified Brick, laid on a gravel foundation and awarde the contract to
<br />0.11.DEFREES he being the lowest and best bidder upon IvIa,rion Block..
