If no payment is received within thirty (30) days of a <br />discontinuance of service, provided there has been no metered <br />use at the account location; <br />2. If there has been no response or payment from the customer ten <br />(10) days following a Deceased Account Notification letter. <br />3. After three (3) months of returned mail and no response from <br />customer, provided there has been no metered use at the <br />account location. <br />F. Remedies <br />The remedies provided herein, the Utility's Rules and Regulations, <br />shall not be exclusive and shall be in addition to any other remedies <br />which the Utility has at law or in equity. Discontinuance of service for <br />any reason shall not invalidate these Rules and Regulations or any <br />contract, and the Utility shall have the right to enforce any contract <br />notwithstanding such discontinuance. <br />IX. METERING <br />A. Ownership and Type: of Meter and Pit <br />Water usage will be measured by cold water meters of manufacture <br />and specifications approved by the American Water Works Association. <br />All meters, with the exception of sewage credit meters, will be <br />furnished, installed, removed, maintained, and owned by the Utility. <br />However, the customer will be held responsible for any theft or <br />damages to the Utility's meter. The Utility reserves the right to <br />determine the number, type and size of meters that shall be used in <br />connection with any service pipe. Meter size will generally be <br />determined by the customer and will be equal to or slightly less than <br />the service line size. <br />+ Sewqge, Credit Meters — To more accurately reflect a proper sewage <br />charge, a sewage credit meter may be furnished, installed, owned <br />and maintained by the customer in order to measure the amount of <br />water which does not enter into the sewage collection system, such <br />as by evaporation or product water. A sewage credit meter must be <br />one (1) meter and not the net of two (2) or more meter readings. <br />Pursuant to South Bend Municipal Code, Chapter 17, Article 2. <br />Division 4. Sec. 17-22. <br />Setvqge Only Metering - In case of a private water supply, such as a <br />well, where the customer is attached to the sewage collection <br />system, the Utility will require metering of the water to account for <br />sewage treated.
