Munici al Utilities and Service Lines ..............___ Rules and Re, ulations <br />3. Without Customer's Request and With Prior Notice <br />The Utility may disconnect water service to a water consumer or <br />any property without request by the customer for any of the <br />following reasons, provided it notifies the customer as set forth <br />here: <br />a) The customer fails to make any necessary repairs <br />required by the Utility. This shall apply to the service <br />pipe or appurtenances thereto, the meter setting and <br />location, any private fire protection systems, unmetered <br />facilities or any violations of plumbing code as adopted by <br />the City of South Bend. <br />b) The customer vacates the premises, or fails to pay any <br />portion of their utility bill or other charges within thirty <br />(30) days of the due date indicated on the customer's bill. <br />c) The customer does not provide free, adequate and non- <br />hazardous access to the premises and the meter. <br />d) For violation of any of the Utility's Rules and Regulations. <br />The Utility shall give written notice to the water consumer or <br />property owner of its intention to discontinue water service. The <br />notice must be mailed not less than seven (7) days prior to the <br />proposed disconnection. As an alternative, the notice may be <br />hand -delivered not less than seven (7) days prior to the proposed <br />disconnection to the consumer or a responsible person on the <br />premises at the service address or other known address of the <br />consumer or property owner. <br />4. Procedure for Involuntary Disconnections <br />a) Designated shut-off employees shall leave notice of shut- <br />off on customer's door at the time of shut-off. <br />b) Shut-off employees shall not accept any payments of any <br />type to avoid discontinuance of water service. <br />B. Prohibited Disconnection <br />Except as otherwise provided herein, under Section VIII. <br />DISCONNECTION OF SERVICE, Subsection A.; <br />1. The Utility may not disconnect service to the customer: <br />a) Upon their failure to pay for services rendered at a <br />different metering point, residence, or location if such bill <br />has remained unpaid for less than forty-five (45) days. <br />b) Upon their failure to pay for services rendered to a <br />previous occupant of said premises to be served, unless <br />the Utility has good reason to believe the customer is <br />attempting to defraud the Utility. <br />c) If the customer shows cause for their inability to pay the <br />M, <br />
