Moving from the <br />premises does not absolve the customer from their obligations. A <br />customer's service may be discontinued for failure to pay for service <br />rendered to them at a previous location if such bill has remained <br />unpaid for more than forty five (45) days. Until the Utility has been <br />notified to discontinue service to the premises, the customer will <br />remain responsible for any charges to that property. <br />G. Unconnected Sewage Custoniers <br />The Utility is authorized under IC 36-9-23-30 to require connections to <br />sewer and discontinuance of privies, cesspools, septic tanks and similar <br />structures; conditions: <br />1. Subject to subsection 2., a Utility that operates sewage works <br />may require: <br />a) Connection to its sewer system of any property producing <br />sewage or similar waste; and <br />b) Discontinuance of the use of privies, cesspools, septic <br />tanks and similar structures. <br />2. The Utility may exercise the powers granted by subsection 1., <br />only if: <br />a) There is an available sanitary sewer within three <br />hundred (300) feet of the property line of the affected <br />property; and <br />b) The Utility has given notice by certified mail to the <br />property owner at the address of the property, at least <br />ninety (90) days before the date specified for connection in <br />the notice. <br />3. The Utility may establish, enforce and collect reasonable <br />penalties for failure to make a connection under this section. <br />4. The Utility may apply to the circuit or superior court for the <br />county in which it is located for an order to require a connection <br />under this section. The court shall assess the cost of the action <br />and reasonable attorney's fees of the Utility against the property <br />owner in such an action. <br />H. Sewage Liens <br />A lien may be filed against a property to collect delinquent sewage <br />charges pursuant to Indiana Code 36-9-23-31, 32, 33, 34, and 36-9-25- <br />11.2. <br />
