<br />.IMPROVFAF,1,TT RESOLUTION No. 59.
<br />Resolved by the Board of Public Works of the City of South Bend, Indiana.
<br />r That it is desired and deemed necessary, to make the following described public improve-
<br />ments in the said City as authorized by the foilowing nunbered Improvement Resolution,
<br />adopted by said Board on the loth. day of March 1911.
<br />Resolved that an improvement be made of. the kind, size, location and
<br />terminal.points as follows: Beginning at the center of Leland Avenue and Angella
<br />Avenue, thence westerly along the center line of said Angella Avenue .to the center .of
<br />Woodward. Avenue with a 201' vitrified pipe sewer; thRnee",northerly along the center line
<br />of said Woodward Avenue and Blaine Avenue to the center of McCartney Street with a 20"
<br />vitrified sewer pipe; thence west along the center of said McCartney Street to the center,
<br />of Porttage Avenue with an 19" vitrified sewer pipe; thence northerly along the center
<br />line of said Portage Avenue to South 1%£, line of Section 35 T.3F R. 2 east with a 15"
<br />vitrified Aewer pipe. Also beginning at the center of McCartney Street and Portage
<br />Avenue thence ,southerly along the center line of said Portage Avenue to h point 25 feet north
<br />of the Northerly line of the Chicago, Indiana rand Soivahhern Railroads Company's right-of-
<br />way jNith a 12" vitrified se-yer pipe. Together with the house connections to the curb
<br />line _along the line of said improvement.
<br />Detail drawings, plans, profiles and specifications are on file and may
<br />be seen at -the office of said Board and all work _in the rmakin,q of said public improvement
<br />.ri:tst be done in accordance therewith.
<br />Said improvements slIall be known and designated as ANGELLA AVENUE,
<br />McCARTNEY STREET AND PORTA:=,E AVENUE SEWER SYSTFX. Notice of this resolution shall be
<br />published on the l9th. day of March and on the 25th. day of March 1911 in the South Bend
<br />Deily Timers. Said Board has fixed the 7th. day of April 191.1 as a date upon which
<br />remonstrances may be filed or J:h.eard by persons interAst.ed or affected by n€-40. public
<br />improvements and on said day at 7:15 P.M. said Board will at its r€cid. office hear and
<br />consider €any remonstrators and person interested or whose property is affected by said
<br />public improvement and will decide whether the benefits that will accrue to tale property
<br />abutting.and adjacent to the proposed improvements and to said City, will be equal to or
<br />exceed the estimated cost of the proposed improvements, as estimated by the City Civil
<br />Engineer. A boiid or bonds to be issued to the Contractor in payment of ,such work
<br />where the property owner signs waiver required, as according to law. which said bonds
<br />shall beer interest at the rate of six per cent per ennui, payable as provided. by law.
<br />The City Engineer ,submitted the lust of property owners in the matter
<br />of the Appropriation of certa.n property under condemnation resolution Nurber 91 which
<br />list includes the names of the owners and. holders of property and of interests therein
<br />sought to be taken or benefieialQ or injuriously effected, n.nd the description of the
<br />several pieces of property t+vhich is affected by the said appropriation proceedings.
<br />• Thereupen the Board proceededto award the damag s sustained and to
<br />e,^sess the benefits accruing to each piece of property upon said lis .
<br />It was thereupon, upon motion duly made and seconded and unanimously
<br />adopted; rerolved that Said lis t, togiLther with the amounts of benefits ^,nd damages
<br />acid net benefits and net damages therein set forth as to the several parcels of lend
<br />be adopted and ordered spread upon this record by reference, and that the respective
<br />amount of benefits contained in said list be and are hereby assessed against the
<br />several tracts of land as specifically set Forth in said list, and that the respective
<br />amounts 'of damages contained in t_ne said list be and are hereby awarded to the several
<br />tracts of land as specifically set forth in said list, and that tile net benefits or
<br />net damages, as the case may be as to the respective tracts, of land contained in, said
<br />list are 'hereby awarded or assessed, as the case may be as to the said several tracts of
<br />land. The Board hereby further sets off t e benefits: and damages each
<br />against the other where both benefits and damages are as^es;sed against the sAfne apiece
<br />of property, tract of land or interest, and hereby fixes 'said respective net benefits as
<br />the amount that shall be paid by the respective owners as benefits, and further hereby fixe
<br />the respective .n6t damages as to the several tracts as the amount that shall be paid to
<br />the owners of the respective tracts as damages.
<br />Thereupon, upon motion duly made and. ,seconded a7,d unanimously
<br />adopted, the tenth clay of November was fixed as the day on which this Board will receive
<br />or heir remonstrances from persons with regard to the amount of their respective awards
<br />or assessments, and the clerk of this Board was instructed to prepare and cause to be
<br />duly and legally given, notices to the owners of each parcel of property, showing the
<br />amount of the assessment or ward, with a descri tiat} of the rop�erty ' ;ected ., rind the

<br />on the 2.9th. day of April 1911 for the purpose of hearing any remonstrances which you
<br />may desire to present in regard to the amount of your award of damages oornasse_ssmint
