Woodsalyo.�'for he vaca3Qn of <br />five5g feet of south side of La Monte Terr€�ee was placed on file and not granted. <br />February 25,1922. <br />Board of Public Works, <br />City of Sou th Bend, Indiana. <br />Gentlemen: <br />In reply to your requ est for an opinion upon the annexed petition, I be <br />to advise that I have examined the law with respect to vacation proceedings and whfie <br />I am ndt informed as to the exact question on which you want an opinion, I can say <br />nnerally that the Board of Works has power to order the vacation of a street or part <br />hereof as provided by Clause 5,Section 8696 Barns Rev. St. If the Board desires to <br />vacate this strap it will be necessary to pass a preliminary resolution giving notice <br />of the same by publication fixing & time for hearing on remonstrances and at fuch hearing <br />-take final action confirming , modifying or rescinding such resolutions, 'Thereafter, <br />the Statute provides for the necessary steps as shown by the sections of the St4tu to <br />following Section 8696. <br />All of the proceedings relating to vacation of streets appear in Thornton's <br />Law of Cities and Towns Sections 97 to 104 inclusive., Since this vacation seems to be <br />for•the benefit of the property ovmers on the South side.of La Monte Terrace, I think <br />it *oa ld be entirely proper for the Board to require them to pay the costs of sUch <br />proceedings if the Board so desires. <br />FILED ° <br />FEB. 21,1922; <br />PETITION NOT GRANTED <br />BOARD OF PUBLIC WORKS <br />BY L. Same read and placed on file and bids ordered advertised <br />for. . <br />February 23,1922, <br />Board of Public forks. <br />Sou th Bend, Indiana. <br />Gentlemen: - <br />I have been asked for an opinion as to the necessity of publish ng notices fo; <br />bidding for street lighting,°referring parttdularly to the contract of the Welsbach Street, <br />Lighting Company for lights in River Park Clause 9, of Section 8696 Barns Rev. St. <br />provides as follows: <br />" The Department of Public Works at least twelve months before the <br />expiration of any Such contract or contracts which are or may hereafter be in force <br />shall be published once each week for two successive weeks in a newspaper of general <br />cireu lation in such City, give notice that it will receive bids for such supplies" . <br />I can not find that this requirement of the law has ever been changed excep- <br />that this notice will now be required to.be published in two newspapers of opposite <br />Political faith. <br />FILED Respectfully yours, <br />FEb. 26,1922.
