restated development plan for the West Washington Chapin Area (the "West Washington Chapin <br /> Plan"); and <br /> WHEREAS, the Commission on April 11, 2019, approved and adopted its <br /> Resolution No. 3480 entitled "Resolution of the South Bend Redevelopment Commission <br /> Amending the Boundaries of the South Side Development Area and the South Side Development <br /> Area Allocation Area No. 1, Amending and Restating the Development Plan for Said Area and <br /> Regarding Related Matters" (the "South Side Declaratory Resolution"); and <br /> WHEREAS, the South Side Declaratory Resolution(i)transferred certain territory <br /> from the River West Area to the South Side Development Area (the "South Side Area"); (ii) <br /> designated and declared certain areas within the City to be redevelopment areas and allocation <br /> areas for purposes of tax increment financing to expand the existing South Side Area; (iii) added <br /> certain parcels of property to the South Side Area property acquisition list; (iv) approved the <br /> transfer of certain parcels of property previously included on the River West Area property <br /> acquisition list to the South Side Area acquisition list; and (v) approved an amended and restated <br /> plan for the South Side Area (the "South Side Plan"); and <br /> WHEREAS, on April 16, 2019, the St. Joseph County Area Plan Commission (the <br /> "Plan Commission") adopted and approved its resolution, a copy of which is attached hereto as <br /> Exhibit A, determining that the River East Declaratory Resolution, the River West Declaratory <br /> Resolution, the West Washington Chapin Declaratory Resolution and the South Side Declaratory <br /> Resolution (collectively, the "Declaratory Resolutions") and the River East Plan, the River West <br /> Plan,the West Washington Chapin Plan, and the South Side Plan(collectively,the"Development <br /> Plans") conform to the plan of development of the City, and designated such resolution as the <br /> written order of the Plan Commission approving the Declaratory Resolutions and the Development <br /> Plans, as required by Section 16 of the Act(the"Plan Commission Order"); and <br /> WHEREAS, Section 16 of the Act prohibits the Commission from proceeding until <br /> the Plan Commission Order is approved by the legislative body of the City; and <br /> WHEREAS, the Common Council of the City (the "Common Council") is the <br /> legislative body of the City and now desires to approve the Plan Commission Order in order to <br /> permit the Commission to continue to proceed with the redevelopment and economic development <br /> of the River East Area, the River West Area, the West Washington Chapin Area, and the South <br /> Side Area; <br /> NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of <br /> South Bend, Indiana, as follows: <br /> SECTION I. The Plan Commission Order is hereby approved, ratified and <br /> confirmed in all respects. <br /> SECTION II.
