BILL NO. 19-35 RESOLUTION NO. 4789-19 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING AN ORDER OF THE ST. JOSEPH COUNTY AREA PLAN COMMISSION APPROVING CERTAIN DECLARATORY RESOLUTIONS AND AMENDED AND RESTATED DEVELOPMENT PLANS FOR THE RIVER EAST DEVELOPMENT AREA, THE RIVER WEST DEVELOPMENT AREA, THE WEST WASHINGTON CHAPIN DEVELOPMENT AREA, AND THE SOUTHSIDE DEVELOPMENT AREA ADOPTED BY THE SOUTH BEND REDEVELOPMENT COMMISSION WHEREAS, the South Bend Redevelopment Commission (the "Commission"), governing body of the City of South Bend (the "City") Department of Redevelopment (the "Department") and the Redevelopment District of the City of South Bend, Indiana (the "Redevelopment District"), exists and operates under the provisions of the Redevelopment of Cities and Towns Act of 1953 which has been codified in Indiana Code 36-7-14, as amended from time to time (the"Act"); and WHEREAS, the Commission on April 11, 2019, approved and adopted its Resolution No. 3479 entitled "Resolution of the South Bend Redevelopment Commission Amending the Boundaries of the River East Development Area and the River East Development Area Allocation Area No. 1, Amending and Restating the Development Plan for Said Area and Regarding Related Matters"(the"River East Declaratory Resolution"); and WHEREAS, the River East Declaratory Resolution (i)designated and declared certain areas within the City to be redevelopment areas and an allocation area for purposes of tax increment financing to expand the existing River East Development Area(the"River East Area"); (ii) added certain parcels of property to the River East Area property acquisition list; and (iii) approved an amended and restated development plan for the River East Area(the"River East Plan"); and WHEREAS, the Commission on April 11, 2019, approved and adopted its Resolution No. 3478 entitled "Resolution of the South Bend Redevelopment Commission Amending the Boundaries of the River West Development Area and the River West Development Area Allocation Area No. 1, Amending and Restating the Development Plan for Said Area and Regarding Related Matters" (the"River West Declaratory Resolution"); and WHEREAS, the River West Declaratory Resolution (i) removed certain territory from the River West Development Area (the "River West Area"); (ii) designated and declared certain areas within the City to be economic development areas and allocation areas for purposes of tax increment financing to expand the existing River West Area;(iii)transferred certain territory from the West Washington Chapin Development Area (the "West Washington Chapin Area") to the River West Area; (iv) added certain parcels of property to the River West Area property acquisition list; and (v) approved an amended and restated plan for the River West Area (the "River West Plan"); and WHEREAS, the Commission on April 11, 2019, approved and adopted its Resolution No. 3481 entitled "Resolution of the South Bend Redevelopment Commission Amending the Boundaries of the West Washington Chapin Development Area and the West Washington Chapin Development Area Allocation Area No. 1, Amending and Restating the Development Plan for Said Area and Regarding Related Matters" (the"West Washington Chapin Declaratory Resolution"); and WHEREAS, the West Washington Chapin Declaratory Resolution (i) removed certain territory from the West Washington Chapin Area; (ii) added certain parcels of property to the West Washington Chapin Area property acquisition list; and (iii) approved an amended and
