The following assignment was filed and approved by the Board. • ASST a1A4ENT This Agreement, made by and between Joe A, Luther of the City of South Bend, Indiana in the State of Indiana` party of the first part, and George Pontarellie located in the City of South Bend, Indiana party of the second part; WITNESSETH. WHEREASAS the said party of the First Part has made and entered into a contract with the City of South Bend, for the improvement of Bissell Street from Eddy Street to Arthur Street, under Improvement:Resolution No. 865. in the City of South Bend, Indiana for pipe sewer, Whereas, it.has been proposed that the, said party of the -first part assign said co tract to said party of the second part, upon receiving consent to in writing.of the Board of Public Works of the City of South Bend,. Indiana. Now Therefore, said Party of the first part does hereby sell, assign nd set over onto he said part of the second ar , its suceeserl and a,ssigns, the ai aoritract, an all rights and _nterests therei�i g�ven to or acqu. re by th ate said,party of.the first part, together with.the right to receipt all payments and compensation for work done, by said contract, therein provided to be paid,.with full power and authority to give,proper receipts andacquittances therefor, either in the name Of the party -"of the first part or of the pp rty of the second part, In consideration off' premium; %e party of the second part agrees to perform the work provided to be done by the party of the first -part in said contract, in the war and manner therein provided, and to assume all the liabilities and obligations assumed by or imposed upon the party of the first part in said contract, and to relieve _.the said party of the first part of all responsibilities therefor, This agreement is conditioned and shall become operative only when the consent in writing to the making thereof shall have been given and endorsed thereon by the said Board of writing Works. Shank his wife bearing date d'f June 6,1917, to the proprietors hereof, and recorded in deed record No. 156 at Page 370 of the public records. The annexed plat comprises 24'town lots numbered from No. 13 to -No. 36 both inclusive as shown on the plat. Ajaeent, plats heretofore receoved, are shown on the mar- g in of this plat the better to eseptain same.
