<br />The cost if said improvement, including the cost of the street and
<br />alley intersections shall°be assessed upon the real estate abutting� on said Hastings
<br />Street from ClifforA Court 'to alley west of Sixth Street all° according to the method
<br />and manner pprovided for in an Act=of the General Assembly of the State of *InCiana,
<br />entitled % Abt Concerning Municipal Corporations, " approved March 6,1905, and in'
<br />accordance with and pursuant to the provisions of all amendatory and supplemental sets
<br />thereto, passed by the General Assembly of the State of Indiana. Assessments, if des
<br />fered, are to be paid in ten equal annual insti.11ments, with interest at the, rate of
<br />Six per cent per annum. A bond or bonds shall be issued to the contractor in payment
<br />of such work, unless theproperty owners pay said assessment before said bond or bonds
<br />are issued. Under no circumstances shall the City of South Bend, be, or be held°
<br />responsible fora sum er sums due from said pwaer or owners for said work or for,
<br />the collection of he same, or or the paymszt of any bond , bonds, certificate or
<br />certificates, issued to said contractor in payment for sueh.work, except for such money
<br />F ag shall have been actually received by the City from the assessments for such
<br />—improvement, or such moneys as said City is by said above entitled Act required to
<br />pay. All proceedings had, and work done"in the making of said improvement, assessment
<br />of°property, collection of assessments and Issuance of bonds therefor, shall be as
<br />provided for in said above entitled Act and amendments thereto.
<br />Notice of this resolution shall be published on the 27t dad of
<br />April 1921 and on the 4th. day of May 1921 in the Sottish Bend Daily Evening News -Times
<br />This Board will give a hearingon this resolution in its office in the City.Hall on
<br />t e 18th. day of May 1921 at :15 P.M.
