., <br />to�A�e� 7�rt+s�ry `?lth 74'�1 f'nntinnP <br />R E S 0 L U T I 0 N. <br />WHEREAS, the Board of Public Works of the City of South Bend has entered <br />into negotiations -`with the'Grand Trunk Railway Company$- with a view of removing the tracks <br />from West Division Street, and <br />WHEREAS,, the Grand Trunk Railway Company has made a proposal to the Bow_ <br />-of Public Works offeria to remove the tracks from West Division Street, and elevating <br />ton the Condit on that the City of South Bend ay to'the Grand Trunk Railway„Compa <br />he same, <br />the sum of Three Hundred Ninety -One Thousand Dollars (�391.000.00) and <br />WHEREAS, the City of South Bend must have the authority from the <br />Legislature, in order to c -Out this proposal. <br />` THEREFORE, befit resolved,by the Members of the South Bend Real Estate Board <br />that it is the sense of this Board that -it will be to the ¢dvanta a QQf the City of South <br />Bend to consider,favorably the Grand Trunk Railway Company s_proposal and that we urge the. <br />Senators and Representatives from this Count and District to support a Bill empowering the <br />City of South Bend to enter into an_agreemenll with the Grand Trunk Railway Company for the <br />removal of the Ta cks f;om Division Street &nd to raise the move required by assess#n <br />the real estate Tacks <br />by the removal of the tracks from Div sion Street -and by difect <br />taxat o r a bond issue. A, Elliott, President of <br />the Board was ordered recorded on Committee to Indianapolis on Legislature matters ap <br />foll'oft , to -wit:- ` <br />WHEREAS, The City of South Bend, through itsBoard of Public Works: <br />has been negotiating with the Grand Trunk Railroad Company for <br />the elimination of the tracks of said Railroad on Divisision Street,, <br />and <br />WHEREAS: The said City of South Bend is in receipt of a written offer of the <br />Grand Trunk Co )any under date of December 15,1920 stating the <br />terms andconditions <br />eons upo which theoGrStreTrunk nRailway Company <br />would consaid <br />WHEREAS: -To legally contract with the Grand Trunk Railroad Company for the <br />elimination of its tracks on Division Street it is necessary_ to have <br />special legislation boverinR this articular subject all which <br />matters have been referred to the Legal Department off --the City and they <br />Legal De artmen has drated a bi ivin th Ct�hh Suth B nd the <br />ne essar powerto enter into a wr to con rac w e rand rusk <br />Railway Vompany, and <br />WHEREAS:. It,is necessary that said bill be introduced in the present <br />Session of the Legislature now meeting at Indianapolis its pro- <br />visions explained to the Committee of the Legislature to which said. <br />Bill may be referred which matters will require that officials -of the <br />City of South Bend, hie. resent at said Committee hearings in <br />Indianapolis, NOW THEREFORE <br />BE IT RESOLVED BY THE BOARD OF PUBLI WORKS of the City of South Be4d That <br />Thomas W.-Sl7ick, City Attorney and. G. A. Elliott Member of -this <br />Board, err:ahy-otlxer City official as designated by the said <br />Committee are hereby authorized and empowered to represent this City, <br />before any committee of the House of Senate of the State Legislature. . <br />in the interest of the City in this Bill, and to do any and all <br />things necessary to secure the proper passa a of the measure as <br />submitted by the Legal Department of this Cty of South Bend <br />The.above named City officials are further authorized to call upon the <br />En ineering Department for any and all data, blue prints or other <br />matters deemed necessary to be .presented to said Committee. The <br />officials herein. selected to represent the City of South Bend, to <br />keep an`account of all expenses incurred in the different trips to <br />Indianspolis, and at the close of the Legislature to present this <br />Board with an itemized statement together with the Vouchers coverings; <br />same, and this Board will reimburse said parties for the necessary, <br />sums so expended. It being the intention of this Resolution to <br />completely cover all the expenses incurred by the -above named parties <br />in the proper presentati88 and passage of this measure. <br />,Y <br />
