W n �r�sav SantgEbtr 3st 1920 Cont <br />This being the date set for the making of final award on type of <br />pavement on,walnut Street from Sample Street to Indiana Avenue and awarding of <br />contract on said 'street. Attorney A Wolf and Harry Sanders of Sanders & Egbert, <br />Attorney Seybold, L. E. Couter and F. C. Raff of the Oliver Chilled Plow Works <br />were present at' said meeting and discussed with the Board the advisability of award- <br />ing contract at this time. Attorney Seybold and F: C. .off representing Oliver's <br />stated -;to the Board that Mr. Oliver wanted the pavement put in on Walnut Street <br />this Fall, on account of their new factory buildings going in there and they needed <br />a pavement to get in and out to their new buildings, Attorney Wolf representing <br />Sanders & E gbert stated that `this company did not want any pavement put in until <br />all switch tracks necessary for their business was first put in on Walnut Street. <br />+.he Board after careful consideration decided to defer the <br />awarding of the contract on Walnut Street until Thursday September gth.tl920 at <br />9: 00 A.M. <br />Attorney Arthur Gilliam appeared before the Board in regard to <br />contract for the operation of auto ,buses on certain streets in the City. Same <br />referred to the City Attorney for report. <br />Copy of contract filedyy the Board, .. <br />r <br />CONTRACT. <br />This agreement m de and entered into this day of <br />1920, by and between the City of South Bend, by and through its Board of Public <br />Works, hereinafter called first party, and the South Bend Motor Bus Company a <br />corporation duly created and organized under the Jews of the State of Indiana, <br />hereinafter called second party, Witnesseth: <br />That consent , .permission and authority are hereby given and <br />granted by first party to and vested in second party, its successors and assigns, <br />to operate its commercial vehicles, commonly known as.jitney busses, for the <br />purpose of carrying passengers, for a period of fifty (50) years, over the follow- <br />ing streets and routes in the City of South Bend, Indiana:- <br />L. On South Main Street between Washington and Division Streets <br />and on Div is ion Streets between Main and Olive Streets, <br />2. On South Main Street between Washington Street and Jefferson <br />Blvd. on Jefferson Blvd. between South -Main Street and South LafayetteStreets, <br />on South Lafayette Street between Jefferson Blvd., and West Sample Street, On West <br />Sample Street between South Lafayette and South Franklin Streets, on South <br />Franklin Street between West Sample Street and West Indiana Avenue; on West Indiana <br />Avenue between South Franklin Street and South Xemble Avenue., and on South Kemble <br />Ave. between West Indiana Ave.,, and EwingAve. <br />3. On Washington Str et from Main Street to Lafayette Street, on <br />South Lafayette Street from Washington Street to Test Broadway, on West Broadway <br />from South Lafayette Street to•South Main Street, on South Main Street frem West <br />Broadway to Indiana,, on Indiana Ave., from South lain Street to South Leer Street <br />on South Leer .Street from Indiana Ave. to Calvert Street and East on Calvert Street. <br />4. On Sample Street between Lincoln Way Eastand Chapin Street. <br />Said second party agrees to opira.te its said vehicles over <br />said streets and routes regularly add in accordance with a regular time schedule <br />adequate to the convenience and necessity of the inhabitants of said City; second <br />party further agrees not to pick up any passengers at intersections of any of said <br />streets with the Chicago, South Bend & Northern Indiana Railway Company's tracks <br />except at the downtown starting points; Said second party also agrees to comply <br />with tchtprovisions and requirements of any ordinances now or hereafter in force <br />in said rigulaxt ing such traffic. <br />First party further g,rants.the right to second party to erect <br />and maintain suitable signs .along said streets and routes, advertising its stops and <br />schedules; said first party agrees not to enter into any similat contract granting <br />a similar right to any other applicant c over ing the same streets and routes, unless <br />such applicant first files with the Board of Public Works of said ,City a. vert if fed <br />statement to the effect that public convenience and necessity require the granting <br />of such second right, and which statement shall be signed by not less than five <br />householders from each block of the street or streets for which application is made, <br />and if that number of householders does not reside in array one boock, then said <br />statement hh.all be signed by all householders residing on such bloke; provid ied <br />that it such statement it filed, the granting of such contract shall rest in the <br />
