4 Indiana, St. Rose Street Rose Street The following resolutions were approved by the Board. SIDEWALK IMPr OVEr0 ENT RESOLUTION NO. 837. Resolved by' the Board of Publ io Works of the City of South Bend, Joseph County, State of Indiana, That it is deemed nee essary to improu from Portage�Avenue to Kessler Boulevard and Kessier'Boulevard from to Beale Street as f ollows, t o-wit: - Said streets shall be graded from property line to property line, also cement curb and cement sidewalk shall be con- structed on both sides off' said streets, all as is more particularly shown and all in accordance with the plans, profiles, detail drawings and specifications on file in the office of the Department of Public Works of the City of South Bend, Indiana. in accordance with theprofiles details drawings and specifications an file in the office of the Department of the Board of Public Works of said City; and such improvement is now .ordered. The cost of said improvement, including the cost of the street and alley intersections, shall beassesssd upon the real estate abutting on said Rase and Kessler Blvd. all according to the method and manner provided for in an Aut of the General Assembly of the State of Indiana, entitled " An Act Concerning Municipal Corporations, " approved March 6,1905, and in accordance with and pursuat to the provisions of all amendatory and supplemental acts thereto , passed by the General Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal annual installments, with'interest at to rate of six per cent per annum. A bond or bonds shall be issued to the contractor in payment for such work, unless the property owners pay said assessment before said bond or bonds are issued,. Under no circumstances shall the City of South Bend, -be, or_b,e held respon- sible for any sum or sums , due from said property owner or- owners for aid work or for the collection of the same, or.. for the payment of any bond, bonds , . cert if i°- cate or certificates, issued to said contractor in payment for such works except for such moneys as shall have been actually received by the City from the assessment for such improvement, or such moneys as said City is by said above entitled act required to pay. All proceedings had, and work done in the making of said improve- ment, assessment of property,- collection of assessments and issuance of bonds ,therefor, shall be as provided for in said above entitled Act and amendments thereto. Notiee'of this resolution shall be published on the 25th. day of August 1920oand on the lst. day of September 1920 in the South Bend Daily Tribune This Board will give a hearing on this resolution in its off ice in the City Hall on the 15th4 day of September 1920 at 7:15 P.M.
