4. If an employee's behavior is erratic, incoherent, or <br />disoriented, or if the employee does not appear to have <br />control over his/her motor functions, the employee will <br />be removed from the jobsite or office and be tested as <br />a "probable cause" situation. <br />5. The Company will pay for one (1) urine drug screen per <br />request, any additional urine drug testing required due <br />to an unacceptable first specimen will be the <br />responsibility of the employee. <br />6. If an employee tests over .04 for alcohol, he/she has <br />violated company policy. Employees who violate this <br />policy will subject themselves to termination of <br />employment. <br />7. Employees who test "positive" will be removed from the <br />project or office. <br />8. If an employee tests "positive", it is the <br />responsibility of the employee to seek rehabilitation. <br />The Company will provide the names and addresses of <br />public or private agencies who may assist <br />contractors/employees that test positive on a drug or <br />alcohol test. The Company does not assume any <br />responsibility for payment of fees beyond the initial <br />testing and random sampling. <br />9. Employees currently working for Beaty Construction, <br />Inc. who refuse to be tested will be terminated. <br />10. All employees are subject to random substance abuse <br />testing. <br />11. Unlawful possession or sale of legal or illegal drugs <br />or other illegal substances or paraphernalia on company <br />premises or work sites shall result in termination from <br />employment without regard to "probable cause" of <br />unfitness for work or adverse affect upon work <br />performance. <br />12. Employees selected for testing for the presence of <br />drugs or alcohol in their systems under this policy <br />will be required to sign the attached Consent and <br />Authorization to Release Medical Information. An <br />employee's failure to do so will be considered <br />insubordination and will result in immediate <br />termination from employment. <br />"AN EQUAL OPPORTUNITY EMPLOYER" <br />
