COMPANY'S RESPONSIBILITY <br />Beaty Construction, Inc. considers healthy, productive <br />employees to be the most valuable asset of the Company. <br />Providing a safe, secure environment for these employees is a <br />serious responsibility. We are, therefore, committed to <br />eliminating the threat to health and safety posed by the use <br />of drugs and alcohol abuse, as stated in the Drug Workplace <br />Act. Beaty Construction, Inc. will use a NIDA certified <br />Laboratory and a 10-panel US DOT approved test. In the event <br />that a 10-panel test is not available, a 5-panel will be <br />used. <br />D. EMPLOYEE'S RESPONSIBILITY <br />1. An employee shall not report for work under the <br />influence of alcohol, legal drugs used unlawfully, <br />illegal drugs, or other illegal substances. Being in a <br />condition unfit for work, because of the effects of <br />alcohol or the illegal use of drugs or other substances <br />while on the jobsite is cause for termination. <br />2. Employees who are taking medically -prescribed <br />prescription drugs which may have an impact on their <br />ability to work must report that fact to their <br />supervisor. The supervisor would then be in a position <br />to determine whether the employee may continue working <br />while under the effects of the medically -prescribed <br />prescription drug, or whether the employee poses a <br />sufficient risk of harm that the employee should be <br />sent home until the employee is no longer under the <br />influence of the medication. <br />3. "Probable cause" for testing of an employee for the <br />presence of drugs or alcohol in the employee's system <br />will be found: if an employee is involved in a life - <br />threatening safety violation; if the employee is <br />involved in an OSHA recordable or lost -time incident; <br />or if the employer has received information from fellow <br />employees or other sources which gives the employer <br />reason to suspect that the employee may have ingested <br />or otherwise be under the influence of alcohol or drugs <br />or other substances. Employees will be tested for <br />alcohol or drugs only under "probable cause" <br />situations. <br />"AN EQUAL OPPORTUNITY EMPLOYER" <br />
