<br /> Councilmember John Voorde explained the procedures to be followed for tonight's meeting in
<br /> accordance with Article 1, Section 2-11 of the South Bend Municipal Code.
<br /> Councilmember Tim Scott made a motion to move Bill No. 05-19 before 03-19. Councilmember
<br /> Jo M. Broden seconded this motion which carried by a voice vote of nine (9) ayes.

<br /> 69-18 PUBLIC HEARING ON AN ORDINANCE
<br /> AMENDING THE ZONING ORDINANCE AND
<br /> SEEKING A SPECIAL EXCEPTION FOR
<br /> PROPERTY LOCATED AT 2610 EAST
<br /> JEFFERSON BOULEVARD, COUNCILMANIC
<br /> DISTRICT NO. 3 IN THE CITY OF SOUTH
<br /> BEND, INDIANA
<br /> Councilmember Oliver Davis, chair of the Zoning and Annexation Committee, reported that they
<br /> met this afternoon and, given time constraints, send this bill forward with no recommendation.
<br /> Jordan Wyatt, Planner for the Area Plan Commission with offices located on the 11th floor of the
<br /> County-City Building, South Bend, IN, served as the presenter for this bill. Mr. Wyatt stated, The
<br /> petitioner is requesting a zone change from OB, Office Buffer District to MF-One (1), Urban
<br /> Corridor/Multi-Family District. They are also seeking a special exception use for a group
<br /> residence. To the north (referencing a presentation which is available in the City Clerk's Office)
<br /> across Jefferson Boulevard are Single-Family homes zoned MF-Two (2), High-Density Multi-
<br /> Family District. To the east is an office zoned OB, Office Buffer District. To the south are two (2)
<br /> family homes zoned MF-One (1), Urban Corridor/Multi-Family District. To the west is an office
<br /> zoned OB, Office Buffer District. On site currently is an office building and parking lot. The site
<br /> plan shows the office and parking lot will remain. This rezoning comes to you with an unfavorable
<br /> recommendation from the Area Plan Commission and the special exception comes to you with no
<br /> recommendation from the Area Plan.
<br /> Councilmember Karen White asked, Could you mention the reasons why this came with an
<br /> unfavorable recommendation.
<br /> Mr. Wyatt replied, They weren't able to come to a successful motion to carry.
<br /> Edward Fisher, 303 East 3rd Street, Mishawaka, IN, served as a petitioner for this legislation. Mr.
<br /> Fisher stated, I'm a registered surveyor. I'm here representing Richard Patterson, the owner of
<br /> Think Big LLC, the owner of the building. This is a dual petition. The first (1st) portion of which
<br /> is to rezone from OB, Office Buffer to MF-One (1), Urban Corridor/Family District. We are also
<br /> seeking a special exception for use of the property as a sober living facility and group residence.
<br /> Here in attendance with me are the Executive Director of Choices Recovery, the potential user of
<br /> the property, the Outreach Coordinator for US Addiction Services and also with me is the Project
<br /> Manager for TIA Corporation, the proposed new owner, Patrick Gerrard. I'm here to address the
<br /> MF-One (1) rezoning, the rest are here to explain to you about the special exception. As you saw
<br /> on the drawing(referencing a slide in the presentation), the property on the south, we are outlined
<br /> in red,is zoned Multi-Family. The property to the west across 26th Street is also Multi-Family. The
<br /> property to the north is Multi-Family. To the east is a dentist's office and then to the east of it are
<br /> Multi-Family residential properties. The other OB on the west side is a parking lot and then
<br /> abutting our parking lot is a vacant duplex. So, in general the neighborhood is MF-One (1). We
<br /> don't feel a change to MF-One(1) is out of the question. If you have any questions about the MF-
<br /> One (1), I really believe that addresses the issue. The more urgent issue, and why everybody is
<br /> here, is for the special exception. If I may, I will yield my time to others to address that issue.
<br /> Alicia Brown, 19532 Sunset Lane, South Bend, IN, served as a petitioner for this legislation. Ms.
<br /> Brown provided packets of additional information(which are available in the City Clerk's Office)
<br /> to Council Members.
