S The following contract was approved by the Board and ordered sent to the Common Council for ratificaion Monday January 27th.,1919. CONTRACT r THIS AGREEMENT made the 25th. , day of January in the year Ninteen Rhundred and nineteen by and between Jmsaph Good hereinafter called the Contractor, and City of South_Bend, . Indiana by its Board of Public Works, hereinafter Balled the owner, WITNESSETH, that the Contractor and the Owner for the consideration hereinafter, named agree asy follows; _ ARTICLE 1, The Contractor agrees to provided all the materials and to perform: all the work shnwn ' do the drawings and' described in' the° spec if icat ions en- titled Addition to the City Hall, South Bend, Indiana prepared by E. R. Austin, Acting ; and in these contract documents entitled the Architect, and to do every- thing required by the General Conditions of the contract, the Specifications and the Drawings. ARTICLE 2. the Contractor agrees that the work under this contract shall be -substantially completed April 1st., 1919. ARTICLE 3. The Owner agrees to pay the Contractor in current funds for the performance of the Contract. Two housand Seven Hundred and ninety Dollard, ($2, 790. 00) subject -to additions and deductions as provided in the General Con- ditions of the contract and to make payments on account thereof as provided° therein, as follows: -Payments shall be made as the work progresses to the amount of 80% of the value of the labor performed and the materials furnished and wrought into the building up to the time that the certificate is issued, less the aggregate of the entire work, a sum sufficient to increase the total payments to 90% of the amount of the contract, and within 65 days thereafter, the balance due under the contract. ARTICLE 4. The Contractor and the Owner'agrees that the General Con- ditions of the Contract, the Specifications and the Drawings, together with the Agrement form the contract, and that they are fully a part' of° the Cnn.tract as if hereto attached or here -in repeated; and that the following is an,exact enumeration of the Specifications and Drawings:—, ne plan and one • set specifications. Contractor shall furnish a Two Thousand -Dollar ($2,000.00)Dollar surety bond, - premium to be paid by owner. It is understood and agreed that this contract shall become effective when confirmed by proper ordinance of the Caammn Council of the City of South Bend, Indiana. The Contractor and the Owner for themsevles, their successors, executors adminstratordl and assigns, hereby to the full performance of the coven- ants herein contained.
