Zoning and Annexation Committee <br />2012 South Bend Common Council <br />The July 10, 2012 meeting of the Zoning and Annexation Committee of the South Bend Common <br />Council was called to order by its Chairperson Council Member Oliver Davis 3:30 p.m. in the <br />Council's Informal Meeting Room. <br />Persons in attendance included Council Members Varner, Henry Davis, Jr., Oliver Davis, Dr. Ferlic, <br />Dr. Varner, Dieter, Gavin Ferlic and White; Mike Schmuhl, Eugene Phillips, Christa Nayder, Sheri <br />Miller Story, Gary Gilot, P.E., Don Inks, Rae, Joseph Shabazz, Mr Shabazz, members of the news <br />media and Kathleen Cekanski - Farrand, Council Attorney. <br />Council Member Oliver Davis noted that the members of the Zoning and Annexation Committee <br />include: Council Members Dr. Varner — who serves as Vice - Chairperson, Gavin Ferlic, Dr. Ferlic, <br />and himself as Chairperson. <br />Bill No. 12 -12 — Rezoning of 501 South Parry Street — Councilmanic District 4: <br />Council Member Oliver Davis noted that Bill No. 12 -12 was continued to this date from the June <br />25th meeting. He then called for an update from the Area Plan Staff. <br />Christa Nayder of the Area Plan Staff noted that the Bill requests a zone change from SG2 Single <br />Family & Two Family District to CB Community Business District. It received an unfavorable <br />recommendation from the Area Plan Commission at its May 15, 2012 meeting. Since the last <br />Common Council meeting, Ms. Nader noted that Council Member Oliver Davis met with the <br />Petitioner, the Petitioner's son, Scott Ford, Catherine Hostetler of the Historic Preservation <br />Commission to discuss concerns raised by the Council. The result of that meeting is the proposed <br />Exhibit A setting forth written commitments which would run with the land. <br />Mr. Eugene Phillips of 509 South Parry stated that he has agreed to all of the items set forth in the <br />written commitments. <br />The Council Attorney read a proposed amendment to Section I of Bill No. 12 -12 which would make <br />reference to Exhibit A, in the event that the Committee would recommend the Bill favorably. <br />During the public portion on the Bill, Sheri Miller Story of 401 East Colfax noted that the Chamber <br />of Commerce has "urban planning concerns" with regard to the proposed rezoning pending before <br />the Council, noting that she was not specifically speaking against the Petitioner himself. <br />Dr. Varner thanked Dr. Ferlic for following thru on this matter and arranging what resulted in the <br />written commitments. He also noted that he appreciates the concerns raised by the Chamber. <br />Council Member Henry Davis, Jr. noted that the City should encourage small businesses. <br />
