<br />be built as follows;- The cost of an adequate local sewer, built along the line above
<br />deser ibed, is hereby eat iwated and f ixod to be of the cast Of the main
<br />sewer to' be built along said line as above set forth, which proportion, as herein estimated
<br />and fixed, shall be taken and adeopted in all computations requiring a knowledge of the
<br />cast df such local sewer if buSlt along the line where the main sewer is to be built.
<br />The c os t of the Construction of said sewer shall be d ivded as dollews: -
<br />1. So much of such cost as shall be equivalent to the construction of aan
<br />adequate local sewer not adapted to receive sewage from collateral dre;ins or sewers, if
<br />built along the proposed lines as here inabove set forth, shall be paid by the abutting.
<br />property holders and the City of S 6uth Bend, if it determined that said City is benef itted by
<br />said sewer in the same manner and to the same extent as local sewers , are paid for by them,
<br />under the Statutes. in such cases made and provided.
<br />2, The excess of cost over and above what would be equivalent to the c9st
<br />of A local sewer, if built along said line, shall be assessed adain6t each piece of
<br />property in the district or area to be drained and against the City, if it be determined
<br />th. t the said City if benef itted by the said sewer, according to the manner and method
<br />prescribed by law, all of .which property beneficially affected lies within the following
<br />described territory in the City of South Bend, County of St. Joseph, and State of Indiana,
<br />to -wit:- Beginning at the intersection of the south line of La Salle Avenue and the First
<br />alley .east of St. Louis Boulevard; thence south -along said alley to a point 66 feet north
<br />of the north line of Colfax Avenue; thence east parallel with and .66.feet .north of Colfax
<br />Avenue to*the first -alley east of St. , Peter Street; thence north &l©ng said alley to a
<br />paint 99 feet south of - the south line of La Salle Avenue; thence east to the east line
<br />of Notre Dame Avenue; thence north 21 feet; thence east 821 feet; thence mouth 120 feet
<br />to alley; thence east along said alley and said alley prodced east to the west line of

<br />with and 120-3/8 feet north of the North line of said La Salle Avenue to Eddy Street;
<br />thence north along Eddy Street to McKinley Avenue running nest; :thence west along McKinley
<br />Avnue to Frances Street; thence south along Frances Street to the First Alley north of
<br />La Salle Avenue; thence west along; said a1Le y to Notre Dame Avenue; thence south along
<br />Notre Dame Avenue to a point 99 feet north of the north line of La Salle Avenue; thence
<br />west to the first alley west of Notre Dame Avenue; thence north -to a point 6-6 feet south
<br />of the south line of Madison Street; thence west parallel with and 66 feet south ofthe
<br />south line of Madison Street 'to tb_e first alley west of St. Peter Street; thence south
<br />along said alley to the place of beginning.
<br />SAID IMPROVEMENT SHALL BE KNOWN AS EAST AL SALLE AVENUE SEWER
<br />UNDER IMPROVEMENT RESOLU-11ON NO. 583, in the City of South Bend, Indiana.

<br />fitted, shall be assessed, as, aforesald,� to pay said -excess of cost over and above what
<br />would be equivalent tothe cost of a local- sewer, all of which w-ill more ' fully appear by
<br />reference to the profiles, map,, drawings and- spec.ificat°ions now on file in the office of
<br />the Department of Public Works• of said, City,, which among other, things, gives the exact
<br />course Of said proposed amain- sewer; overflows;• and' its' appurtenances, and the district
<br />or area which may thereby, as shown by the heavy
<br />boundedy lines marked'an said map, and' drawings,, with° propor words and Lfigures written
<br />thereon, clearly indicating ° what said• heavy° boundary liras represent, and the district
<br />or area embraced thereby. Assessments' if' deferrad;' are to be paid in ten equal annual
<br />installments, with interest, at° the' rate° of sin` por' cent per' ennum. A bond or bonds shall be
<br />issued to the eontraotor in payment for` saki' 1Ybkk, unless the property owners pay said
<br />assessments before said bond or bonds are issued. Under no crieu®stanees shall the City of
<br />South Bend be or be held responsible for any sum or sums due from said property owner or
<br />owners for said work, or for the collection of the .same, or for the payment of any bond,
<br />bonds, certificate or certificates, issued to said contractor in payment for such work,
<br />except for such moneys as shall have been actually received by said City from the assess-
<br />ments for such improvements.
<br />All proceedings had and work done in the Instruction of said main
<br />sewer and its appurtenances, manner of assessment of property collection of assessments
<br />and issuance of bonds therefor, shall be as provided for in an Act of the General Assembly
<br />of, the State of Indiana, entitled " An Act Concerning Municipal Corporations, " in matters
<br />pertaining to the constitution, alteration and mai ntenanei of public drains and sewers,
<br />provid-l-ng for the construc-tion, alteration and maintenance of such sewers and drains,
<br />in such cities and within four miles thereof, also providing for the assessment of pro-
<br />perty specially benef itted thereby for the payment thereof, in whale or in part, and for
