f ) 6 3 The following c ommunicat ion received from the City Cemetery Sexton and read and approved by the Board and the following resolution approved. ° To the Hon. Board of Public Works, South Bend, Ind., ° Gentleman: - our records at this: office shows that Mrs. Susan E. Kimble owns Lot 2 Block 16 Range 1. East. She has lobtdeed to above lot and would be pleased to have you furnish her witk a duplicate deed. Very respectfully , G. M. UREY, Sexton. R E S GLUT ION. WHEREAS, One Susan E. Kimble did purchase from the City of South Bend, Indiana for the consideration of One Dollars the following described property. Lot 2 Block 16 Range 1 East, in the City cemetery of the City of South Bend Ind iana . ° WHEREAS, said Susan E. Kimble having lost said deed and is the sole owner of the above described property, and has no deed for said lot now, BE IT RESOLVED, by the Board of Public Works of the said City, that the Mayor of said City be a6T is hereby instructed to issue a duplicate deed to said Susan E. DEHAVEN It was ;ananlmousl:yUordered by the Board that the City Attorney be notified to settle the claim against City of Mrs. Collie Bolin, also Anton Paslake, on basis as stated in his °letter of July 23rd.,1918 as follows: - July 23rd.,1918. Board of Public Works, South Bend, Indiana. Gentlemen: - I =m enclosing herewith the coarespondence in the above case. You will notice that the claim is one that erase under the former adminstrat ion, and Mayor Keller on Dec. 6,1916 offered to pay the doctor and hospital bill. Mr. Pattee in his letter of liar. 7th., makes the statement that the docbbr bill, hospital bill and X-ray expense ran in the neighborhood of One Hundred ($100.00) Dollars, and I am inclined to think that this amount is reasonable. ° I recommend the payment of one Hundred ($100.00)Dollars as a complete settie-- meat in this case Yours very truly, THOS. On June lot., I addressed a letter to your Beard In regard to the claim of Mrs. Bolin and advised an offer of $50.00 to settle this case. In my letter of June lot., I made the 'statement that in my opinion there is no liability. I intended to say that in my opinion the law of the case is with the City and not with the claimant, hence there would be no legal liability. This is; however, only an opinion and certain evidence might be introduced to change the law of the caser so that it would be with the claimant instead of the City.
