261 <br />Board met in regular session at 10:00 A.M. All members present. <br />Mr'. J. W. Vernon appeared before the Board in response to notice <br />sent and . the matter of repairing sidewalk and refilling .alley along Eleventh Street <br />River Park, where gravel was taken out of and as per contract with Fred Corporan was <br />taken up, and the Board advised Mr. J. W. Vernon to see Mr. Fred Corporan and made the <br />repair- to:sidswaik and refilling of public alley, or else the check for Two hundred and <br />fifty- (25MO) Dollars now on file in the office would be used for the same. <br />Fred Corporan,appeared before the Board in response to notice sent in <br />regard to agreement signed in September 1917 in regard to excavation in alley and under <br />sidewalk on Eleventh Street, River Park. Mr. Corporan agreed to get together with J. W. <br />Vernon and report to the Board Tuesday August 13th.,1918 what had been taken care of. <br />Attorney Chas. Hagerty appeared before the Board in regard, to release <br />of Alex Bukowski contract on Wrnsperger Street Grade, curb and walk and,same,was approved <br />as follo" <br />MUTUAL RELEASE. <br />THIS AGREEMENT made this 6-- ay of August,1918, between the City of South <br />Bend, by and through its Board of Public Works, party of the first part, and Alex <br />Bukowski, South Bend, party of the second part, Witnesseth: <br />WHEREAS, said first party did on the 6th. , day of Apr i1,1918 let a <br />certain contract to said second party for the construction of cement curbs and walks on <br />Ernsberger Street in said City, and <br />WHEREAS, said second party is ready and willing to perform said contract, <br />and whereas disputes and differences have arisen between the City of South Bend and the <br />Chicago, South Bend and Northern Indiana Ry. Co., as to the easement and title to the <br />said. property on which said curbs and walks were to be laid, according to said contract, <br />which disputed and differences will render the performance of said contract by secmd <br />party impossible at this time. <br />NOW THEREFORE, each of said parties hereto hereby release each other <br />from the performance of said contract. Said first party likewise releases the United <br />States Fidelity and Guaranty Company of Baltimore, Md., surety on said bond of said second <br />party, all for the reasons set forth in the foregoing. <br />BOARD OF PUBLIC WORKS, 1st. party <br />by G. Same referred to the Water Department. <br />Mr. W. , D. Teeple, Acting Commissioner of Buildings appeared before the <br />Board and took up the matter of the Hastings building , and the Board unanimously <br />ordered that the Acting Bldg., Commissioner W. D. Teeple proceed to raise said building <br />in compliance with section 1294 of the Building Codes and ordered to employ such persons <br />as may be necessary to cause such bldg. to be torn down and to keep accurate account of the <br />expense incurred and file accurate statement of same with City Controllerof this City. <br />Mr., Chas. E. Starr, City. Electric inn ordered, by the Board to look over <br />the electric wiring and replace and repair same if defective in the City Hail. <br />Street Commissioner, D. C. Layton, took up matter of fixing up Olive <br />Street near O'Brien Factory as per request of Geo. O'Brien. The Board advised Mr. Layton <br />to notify. Mr. O'Brien to get a 'petition signed for said improvement, and present same to <br />the Board. <br />Mr. R. R. Smith, Gen'l. Mgr. Chicago, South Bend & Northern Indiana <br />Ry. Company appeared before the Bmard.in regard to manhole severs between their tracks <br />being to far up and touching motors on their cars. Permission granted Mr. Smith , that <br />his company reset said manholes an the same to be underthm supervision of the City Engineer. <br />
