Continued. ---- <br />SIDEWALK IMP OVEMENTRESOLUTION NO, 581. <br />Resolved by the' Board of Public Works of the City of South Bend, St. Joseph <br />County, State -of Indiana, That it deemed and desired necessary to improve Bentdn Court <br />from Milton Avenue to the first alley north of Milton Court as f ollews, to -wit:, - <br />By grading said Benton Court from property line to property line to the <br />.established. grad-e_,: ALnd zurb ing the roadway with cement curb on both sides of said Court, <br />All as is more -partidiilakly shown, and all in accordance with plans, profiles, detail <br />drawings and spec if icat ions on file in the office of the Department of Public Works of the <br />City of South Bend, Indiana, in accordance with the prof ile , detail drawings, and <br />specifications on file in the Office of the -department of Public Works of the City of <br />South Bend, and such improvement is now -ordered. <br />The cost of said improvement, inc lud ing the cost of street and alley <br />intersections, shall be assessed upon the real estate abutting on Bentda Court, all <br />according to the method and manner provided for in an Act of the General Assembly of <br />the stite of Indiana, entitled " An Act Concerning Municipal Corporations, " approved <br />March q,1905, �-_nd in pursuance * ith and pursuant to the prov is ions, of all &mandatory <br />and suppl,enetal acts thereto, passed by the General assembly of the State of Indiana. <br />Assessments, if deferred,.amto,be aid in ten equal annual installments, with interest <br />at the rate of S ix, per. cent. per. annum. o , Ao bond or bonds shall be issued to the Contractor, <br />in payment of such work, unless the property pay owners pay said assessment before <br />said bond or bonds are issued. Under noc ircumstances shall the City of South Bend, be, <br />or be held responsible for any sum of sums, due from said property owner or owners for said <br />vwork or for the collection of the same, or for the payment of any bond, bonds, cwrti- <br />f icate or certificates, issued to said contract in payment for such work, except for <br />such moneys as shall have been actually received by the City from the assessments for such <br />improvemant, or such moneys as said City is by said above entitled Act required to pay. <br />All proceedings had, and work done in the making of said improvement, assessment of <br />property, collection of assessments . and issuance of 'bonds therefor, shall be as provided <br />for in said above _ entitled Act and amendments thereto. <br />Notice of this resolution shall be published on the 19th.9 day of July <br />1918 and on the 26th., day of July 1918 in the South Bond Daily Tribune. This Board will <br />give a hearing on this resolution at its office in the City Hall on the nth., day of <br />August 1918 at 7:15 P.M. <br />Adopted this 16th., day of July 1918. <br />G. A.
