<br />The following imrovemsnt resolution _adopted by the Board.
<br />STREET OR ALLEY IMPRbvE NT RESOLUTION NO.i 565'
<br />Be It Resolved by the Board of Pub 1 ie Works- of the City of South
<br />Bend, St. Joseph County,, State of Indiana, That it is desired and deemed necessary to
<br />improve Blaine Avenue from La Porte Avenue to Lincoln Way West as follows, to -wit: -
<br />Said avenue shall be' graded , and the roadway thereof shall be paved;
<br />,and also -the roadway of certain portions of Ulm streets and alloys which enter or intersect
<br />said avenue shall be graded and paved.. The` paving material to be used in making ;said im-
<br />provement shall be sheet asphalts bitillithic, asphaltic concrete or brick, and the founda-
<br />tion shall be portland cement concrete fiver (5) inches thick for the sheet asphalti,
<br />bitulithid; as-Daltic. concrete and brick or rolled gravel six (6) inches thick for the brick;
<br />also cement curb shall be constructed along said street where same is not already con-
<br />structed; storm water inlets and conduits shall be shall be constructed where necessary;
<br />all manhole covers and inlets V shall be set to the proper grade and cement ,marginal curb
<br />shall be constructed at all streets and alleys where necessary; all as is more particularly
<br />shown, and all in accordance with the profiles, plane, detaildrawings ;and specifications
<br />on file in the office of the Board of Public Works of the City of South Bend, Indiana.
<br />The cost' of the improvement herein provided for, .excFopt street and
<br />alloy intersections , shall be paid by. special assessment to be levied upon the property
<br />specially benef itted, to the amount at the same may be legally assessed, therefor, in
<br />sec ordancs with an Act of the General Assembly of the State of Ind iana, entitled, " An Act
<br />Concerning Municipal Corporations," approved lurch 6,1905, and in accordance with and
<br />pursuant to the provisions of all acts amendatory and supplmsntal thereto.
<br />The cost° of all street and allay interssct'ions, '-including one-half
<br />off the width of the improvoment opposite street and alleys which run int®,.but do not cross
<br />s ;id roadway hers in t-proposed to be improved and that, portion -of such street or alloy abutting
<br />u on property beloning to said City, or upon property not subject to such: assessment,
<br />shall be paid by `the City in cash sift of its general fund, bf able to do so, or froma fund
<br />cr'a ated by a special assessment to be levied under the provisions of Sect ibn 108 8f the
<br />above entitled Act.
<br />Assessments of ton dollars anti mors- against each lot if deferred are
<br />to be paid in ten equal arinaal installments, with interest at the rate of'Six per con per
<br />annum. A bond or bonds will be issued to the contractor -to the amount of such deferred
<br />assessments in pro rat& payment for such improvement.
<br />U4de-n -no--c ircumstances shall the City of South Bend be, or be ,held
<br />responsible for any sum or sums_ due from said property owner or owners for said work, or for
<br />the collection of the same, or for the payment of any bond, bondep certificate or certi-
<br />f icates, issued to said contractor in payment for such work, except for suhh moneys as shall
<br />have actually been received by the City from the assessments for such improvements or such
<br />moneys -as said City is by said entitled Act and amendments and supplements thereto re-
<br />quired to pay. Aill proceedings had, and work done in the making df said improvement,
<br />assessment of property, collection of assessments and issuance of bonds therefor, shall
<br />be as provided for in said above entitled Act, and Acts aamendatory thereof and supplemental
<br />thereto.
<br />BE -= FURTHER RESOLVED, That the Board of Pub 1 is Works fix the..-13th.
<br />day `of March A.D. 1918 at thw hour of 1: 15 P.N. at the . off ice . of ,the Board of Public Works
<br />of this City, as the time and place for the public consideration of said proposed improve"
<br />went, at which said Board of Public; Works, will hear all persons interested, or whose
<br />property is liable to -be assessed for said improvement, and will decide whether the bene-
<br />fits to the property liable to be assessed for said improvement will equal the estimated
<br />cost thereof.
<br />BE IT FURTHER RESOLVED, That notice of the time and place of such
<br />public consideration be published and mailed in manner provided by law. Notice of this.
<br />resolution shall be published on the 21st.9 day of February 1918 and on the 28th. day of
<br />February 1918 in the South Bend Daily Tribune.
<br />Adopted this 19th, day of February 1918.
