This shall be a eonstruetion bomd, and the sureties on the,same shall not be responsible for the maintenance and repair for the improvement after it has been accepted by the second party, but `such sureties shall be held responsible for the faithful compliance with all other conditions stipulations and requirements coverwd by or set out, in the contract. Concerning the Improvement on the roadwpry of Niles Avenue from Howard Street to Leeper Avenue'in pursuance to resolution No. 551.°the Board finds that no petition has been filed with said Board by a majority in number of the freeholders residing on said street to be improved request.ng that it be improved with a different kind of pavement than the kind heretofore adopted by the Board in its preliminary order; Rnd the City Engineer reports that theWilliston Construction Company is the lowest and best bidder for the kind of pavement heretofore adopted by the Board and the Board find that said Williston Con- struction Company is the lowest and best bidder abd hereby lets the contract for said improvement to him, and all proceedings heretofore had in this matter are hereby confirmed and ratified.
