<br />As you known, the Board of Public Works of this City let a contract over
<br />a year ago for the paving of Eddy Street and Mishawaka. Avenue, an which your company
<br />has and maintains railway.tracks. The contractor has been delayed ever a year
<br />from beginning the, construction of this work, only because of the fact that your
<br />company has failed to procure proper materials for replaying and re-en:onstructing your
<br />said tracks. We gaited on you for many months because of the fact that we , knew that
<br />there was considerable diffieulty in getting stebl orders placed at the present
<br />time, `But site are convinced that the delay has been greater than there has been any
<br />need for. The Michigan Street contract was let approximately the same time, and
<br />your company procured steel for that work in August of last year.
<br />The City has been greatly inconvenienced , and the contractor has been
<br />greatly damaged because of this delay, and we now advise you that we propose to have
<br />this work started at once, and if you do not have thl new material which you desire
<br />to place in this street, the street will be paved with the old material .
<br />We trust that you may be prepared to undertake this.'work dt once, and
<br />place your tracks in the street with whatever material>you have.

<br />LOCAL SEWER IMPROVEMENT RESOLUTION NO. 521.
<br />Resolved by the Board of Pubic Works of the City of South Bend, County of
<br />St. Joseph, State of Indiana, That the construction of a. local sewer intended and
<br />adapted for local use by the property holders whose property abuts Uereon, and not
<br />intended or adapted for receiving sewerage from collateral drains, be and the same
<br />is hereby ordered in and along Brookfield Street from Lincoln Wa* Rest to Vassar
<br />Avenue as ffollows , towit: -
<br />Beginning at the intersection of the center line of Lincoln
<br />Way West and Brookfield Street; thence north along the center line of Brookfield
<br />Street to the center of Vassar Avenue with a. 12 inch vitrified pipe sewer. Together
<br />with the necessary manholes, storm water inlets, conduits, flush tank and house
<br />connections to the curb line along the line of said improvement. All as shown on
<br />the plans and in accordance with the profiles, detail drawings and specifications
<br />on file in the office of the Department of Public Works of the City of South Bemd,
<br />Indiana and said sewer, with all its appurtenances shall be constructed in accordance
<br />with the -)rof ile and specifications now on file in the office of the Department of
<br />Public Works of said City. The cost of said improvement shall be apportioned against
<br />and paid by the property holders whose property abuts thereon, and upon the City.of
<br />South Bend if the City_ id benefitted by said improvement, all according to the method
<br />and manner provided for in Act of the General Assembly of the State of Indiana,
<br />entitled " An Act Cancerning Uunicipal Corporations," approved March 6,1905,
<br />Assessments, if deferred, ° are to be paid in ten equal annual installments, with in-
<br />terest at the rate of Six,per cent per annum. A bond or bonds shall be issued to
<br />the contractor in payment for such work, unless the property owners pay said
<br />assessments before said bond or bonds are issued. Under no circumstances shall the
<br />City of,South Bend be or be held responsible for any sum or sums due from said pro-
<br />perty owner or wooers for said work, or for the collection of same, or for the pay-
<br />ment of any bond or bonds, certificate or certificates, issued to said contractor
<br />in payment for such work, except for subh moneys as shall have been actually received
<br />by the City from the assessments for such improvement, or such moneys a.s said City is
<br />by said above entitled Act required to pay. All proceedings had, and work done in the
<br />making of said improvement, assessment Of property, collections of assessments and
<br />Issuance of bonds therefor, shall be as provided for in said above entitled Act,
