Street, fixing the clearance At said int.►ersect;ioxs bey <br />tween the surface of sald streets°And thq bottom of the superstructure over the sAm , axt <br />sixing the grades of certain streets, was adapted And confirmed by the Board .of' Public <br />Works -of the City of South Bend, Indiana; and. <br />Whereas- " s.Aid resolution as approved And confirmed was submitted to the <br />Common C ounc it of the City of South Bend, Ind ianA, for its Action thereox, And was on <br />the llth. dAy of December',1916 duly Approved by An OrdinAnce #Assed And Adopted by <br />said Common C ounc iil, THEREFORE, ' <br />Be It geseived by the BoArd of Public Works that in pursuance to Section <br />2 of, an Act of the Ge eral Assembly approved lurch 4,1911 ( Ckapter 128 of Acts of 1911) <br />the New York Centrtal_Ra,ilreAd Company be, and hereby is ordered to prepare or cause to be. <br />prepared And filed with the Board of Public Works pl up, And specifications complete And <br />in pArt iculAr As to thAt pArt of the work known As. superstructure , inclxd ixg the retaining <br />walls it Abutments 6 the sides of the streets; and be it further ordered that this <br />Board of, Public Works by its City Civil Engineer shall prepare and file in the office <br />of this Beard complete p1Axs And spec if icAt ions -in pArt iculAr As to thAt pArt of the <br />work bexeAth such superstructure including the approaches on the streets to said improve- <br />ment as well as the sidewalks, the paving and repairing and the changes in drainage <br />4n that part of the s-treets crossed by said tracks , and on that pest of all streets t7go <br />grades of *Xick are changed by said improvement. <br />Also, said Railroad Company shall at the same time that its said plans <br />and spec if icAt ions are filed, file with this BoArd as itemized estimate of the complete <br />cost of the work specified in the p1Ans and specifications so filed by its; and at the <br />t ime sadd .Plane -and spec if ieat ims are so placed on file by this Beard, it shall d_ as <br />place on file at its office an. itemized _estimate of the complete cost of the work spefi- <br />f ied in the plans and spetitiations so filed by it . <br />Axd ail other stoop railroad cOmpanies named in said resolutios No. 2. <br />whose main tracks or side tracks conxect witk or intersect the tracks of the New York <br />Central Railroad CompAxy, and whose said tracks will have to be changed -on and over <br />certain. streets, if said companies shall desire to maintain said connecting or inter - <br />seating trAcks shall 1 ikwiso file plAns and specifications of the chAnges nec essAry <br />in their trAcks ox And over sAid streets. <br />All sAid p1Ans, specifieA tions And estimAtes shall be filed within the <br />off ice of this BoArd within thirty (30) dAys from the time of service. of_ notice ®f'.the <br />pAssAge of this resolution, upon sAid soverAl rAilroAds And sreeet rAilwAy eompAties <br />whose trAcks Are changed or Affected by this proposed improvement. <br />All shAll be done As reQuired herein, And ix sAid modified Resolution <br />No. 2 for TrAck SeparAtion, and in Chapter 128 of the Actsof the General AsseMbly <br />of Indiana for 1911. <br />Passed and adopted this 17th. day of April 1917. <br />E.
